Pursuant to the authority of the Municipal Home
Rule Law and the Suburban Town Law[1] of the State of New York, the Town Board of the Town of
Clarkstown hereby establishes a Department of Purchasing

The Town Board shall, by resolution, appoint
an Authorized Purchasing Agent, who shall serve as the executive head
of the Department. The Authorized Purchasing Agent shall serve for
an indefinite term and shall serve at the will and pleasure of the
Town Board.

1009, pursuant to the authority of Municipal Home Rule Law § 10,
Subdivision 1(ii)d(3), and in conformity with § 22 of the
Municipal Home Rule Law.

The Authorized Purchasing Agent shall, in accordance
with the requirements for the advertising of competitive bidding,
make all purchases and contracts for materials, supplies and equipment
and contract for the rental of service equipment for the Town and
for any Town department, office or agency, except as otherwise provided
by general law. He shall prescribe the form of requisition and receipt
for materials, supplies and equipment delivered without requisition.
No claim shall be paid without the requisition or delivery receipt
being attached thereto. He shall furnish to said Board such statements
and records as the Town Board may direct. He shall perform such additional
and related duties as may be prescribed by law or directed by the
Town Board.
There shall be such other positions of employment
in the Department of Purchasing as may be established by the Town
Board of the Town of Clarkstown.
