It is the intent of the Town Board of the Town of Clarkstown to prohibit the feeding of waterfowl on land of the Town of Clarkstown in order to promote the health, safety, appearance and welfare of all persons within the Town.
It is the purpose of this article to prohibit the feeding of waterfowl on land of the Town of Clarkstown.
As used in this article, the following terms shall have the meanings indicated:
TOWN LANDS
Any real property owned by the Town of Clarkstown.
WATERFOWL
Those game birds commonly known as geese, brant, swans and river and sea ducks, also classified as Anatidae.
No person shall feed any waterfowl on any town lands, except in areas designated for feeding by the Town of Clarkstown Parks Board and Recreation Commission from time to time.

This article shall be enforced by the Animal Control Officers, members of the Clarkstown Police Department and Code Enforcement Officials of the Town of Clarkstown.

Any person who violates this article shall be guilty of a violation and shall be subject to a fine not to exceed $1,000.
Pursuant to the New York State Environmental Quality Review Act, the Town Board has determined and found, by separate resolution, that the enactment of this article will not have a significant impact on the environment of the Town of Clarkstown.

If any section, paragraph, clause, provision or portion of this chapter shall be adjudged invalid or held unconstitutional the same shall not affect the validity of the balance of this chapter as a whole or any part or provision other than the part held to be invalid or unenforceable.
