A.
Purpose. The standards and specifications set forth
herein, whether expressed by direct description or reference to other
sources, are for the purpose of safeguarding and helping to carry
out the policy and intent of this chapter and the intent of any sections
of the Town Law of the State of New York applicable to the review
and approval of plats and site plans and the Code of the Town of Clarkstown.
A.
Waiver of improvements. The Planning Board may waive
any required improvements which, in its judgment, are not necessary
for the protection of the public health, safety and general welfare
of the community.
B.
Adjustments of standards and regulations. Where the
Planning Board finds that, because of special circumstances of a particular
site, extraordinary hardships may result from strict compliance with
this chapter, it may vary the requirements so that substantial justice
is done and the public interest secured. Where the requirements are
varied, the minutes of the Board shall state the extraordinary hardship.
In granting any such variation, the Planning Board shall attach such
conditions, as in its judgment, are necessary to substantially secure
the objectives of the standards or requirements so varied.
Any previous rules and regulations specifically
concerning site plan review and approval are hereby repealed. Regulations
related thereto are hereby reenacted and shall remain in full force
and effect as follows:
A.
Street specifications adopted by the Planning Board
on January 31, 1964, and approved by the Town Board, as amended.
B.
Specifications for sanitary sewer construction as
found in the Code of the Town of Clarkstown.
C.
Street tree specifications as found in the Code of
the Town of Clarkstown and the regulations of the Shade Tree Commission,
as amended.
D.
Subdivision regulations adopted by the Planning Board
and Town Board, as amended.
