This chapter shall be known and may be cited as the "Farm Stands Law
of the Town of Perinton."
This chapter shall apply to the entire area of the Town of Perinton,
excluding those areas within the corporate limits of the Village of Fairport.
No person shall operate a farm stand before April 1 or after November
30 of any year, except that Christmas trees and wreaths may be sold in the
Town of Perinton from November 15 through December 31.
A farm stand operator shall:
A. Not willfully misstate the quantity or quality of any
goods, wares, commodities or plantings offered for sale.
B. Not willfully offer for sale any goods, wares, commodities
or plantings of an unwholesome or defective nature.
C. Keep his edible goods offered for sale well protected
from dirt, dust, insects or other contaminants.
D. Not interfere with the line of vision of traffic or create
any condition which may be hazardous to users of the roadways or patrons of
the farm stand or roadside stand.
E. Not place his stand closer than 10 feet to the edge of
the pavement.
Any person found guilty of a violation of the provisions of this chapter shall be punishable pursuant to Chapter
115, Enforcement Procedures.
