A. No person shall have in his possession with intent to
consume any open bottle or open container containing liquor, beer, wine or
other alcoholic beverage while such person is on any public highway, public
park, public street, or public parking area or in any public place within
the Village of Skaneateles, excepting those premises duly licensed for sale
and consumption of alcoholic beverages on the premises.
B. The Board of Trustees of the Village of Skaneateles expressly
reserves the right to issue a license to benevolent associations which will
authorize said benevolent associations to use open bottles and containers
of alcoholic beverages at Austin Park for certain activities. Permission will
be granted only to those who furnish the Board of Trustees with evidence that
all rules and regulations of the Alcoholic Beverage Commission of the State
of New York have been complied with.
As used in this chapter, the following terms shall have the meanings
indicated:
INTENT TO CONSUME
Drinking from the container, with alcohol on the breath of the possessor
and/or any circumstances evidencing an intent to ultimately consume on any
public lands.
A violation of this chapter shall constitute an offense punishable by
a fine not exceeding $250 or by imprisonment in jail for not more than 15
days, or by both such fine and imprisonment.
