The improved area of a pedestrianway commonly known as "Betar By-Way" shall be for the exclusive use of pedestrians, joggers, bicycles and all methods and modes of nonmotorized vehicles, excepting that this provision is in no way intended to prohibit or limit handicapped access by way of any motorized wheel car utilized by a handicapped person. This section shall not be construed to limit in any way the use of motorized vehicles by the municipality or its agents for maintenance purpose.
Any person who shall operate a motor vehicle or motorized apparatus upon the pedestrianway commonly known as "Betar By-Way" in violation of this article shall be subject to a monetary fine not to exceed $25 for the first offense and for any second and successive violations a monetary fine not to exceed $100 per occurrence.
