The office of Township Manager is hereby created in the Township of
East Whiteland.
The Board of Supervisors shall appoint by a majority vote of its members
a person to fill the office of Township Manager. The person so appointed shall
serve from the first Monday of January of each year until the first Monday
of January next and the office shall be filled annually thereafter. In the
event of a vacancy in the position, the Board of Supervisors shall, by a majority
vote of its members, fill said position for the unexpired term. The Township
Manager shall be subject to removal by the Supervisors by a majority vote
of its members.

The Township Manager shall be a person who possesses both the administrative
and executive abilities commensurate with the duties of the position as hereinafter
outlined. The Township Manager shall be a citizen of the United States and
shall be at least 21 years of age.
Before entering upon his/her duties, the Manager shall give a bond to
the Township with a bonding company as surety to be approved by the Board
of Supervisors in the sum of $10,000, conditioned upon the faithful performance
of his/her duties, the premium for said bond to be paid by the Township.
The salary of the Township Manager shall be fixed annually by resolution
of the Board of Supervisors and shall be set forth in the annual budget, the
actual amount to be as fixed in the budget at the beginning of the year or
by subsequent resolution of the Board of Supervisors in the event the Manager
is hired after the adoption of the budget.
A.
The Township Manager shall be the chief administrative
officer of the Township, and he/she shall be responsible to the Board of Supervisors
as a whole for the proper and efficient administration of all departments,
personnel and affairs of the Township. The powers and duties of administration
of all Township business shall be vested in the Township Manager, except for
any legislative powers and duties, and all duties hereby delegated shall be
subject to recall at any time by the Board of Supervisors. This delegation
shall not include any powers and duties expressly imposed or conferred by
statute upon other Township officers. The daily operation of each department
shall be supervised by the department head who shall report to the Township
Manager and who shall perform his/her duties in accordance with Township policies
and procedures.
B.
Subject to recall by ordinance of the Board of Supervisors
at any time, the powers and duties of the Township Manager shall include the
following:

He/she shall supervise and be responsible for the activities
of all Township departments.
(2)
He/she shall hire all employees, with the exception of
police officers, and when necessary for the good of the service, he/she shall
promote, demote, furlough, suspend and discharge any employee under his/her
supervision, provided that any employee shall be promoted, furloughed, suspended
or discharged only in accordance with the applicable laws of the Commonwealth
of Pennsylvania and the Township of East Whiteland and only in accordance
with the applicable personnel regulations of the Township.

He/she shall recommend his/her suggestions to the Board
of Supervisors and carry out the decisions of the Board to fix wages and salaries
of all personnel under his/her supervision.
(4)
He/she shall prepare and submit to the Board of Supervisors
before the end of the fiscal year, or on such alternate dates as the board
may determine, a budget for the next fiscal year and an explanatory budget
message. Said budget shall be in the format specified by the Board. In preparing
the budget, the Township Manager or an officer designated by him/her, shall
obtain from the head of each department, agency or board or any qualified
officer thereof estimates of revenues and expenditures and such other supporting
data as he requires. The Manager shall review the information so received
and may revise the information before submitting the budget to the Board of
Supervisors.

Upon approval of the budget by the Board of Supervisors,
the Township Manager shall be responsible for the administration of the budget.
He/she shall be responsible for the proper accounting of all income and expenses.
He/she shall ensure that income and moneys spent are charged to the correct
budget categories.
(6)
He/she shall, in conjunction with the preparation of
the yearly budget, develop long-range fiscal plans for the Township, such
plans to be presented annually to the Board of Supervisors for its review
and adoption.
(7)
He/she shall hold such other Township offices and head
such Township departments as the Board of Supervisors shall direct from time
to time, subject to the laws and regulations of the Commonwealth of Pennsylvania.
(8)
He/she shall attend all meetings of the Board of Supervisors
and its committees with the right to take part in the discussions, and he/she
shall receive notice of all special meetings of the Board of Supervisors and
its committees.
(9)
Unless otherwise directed by the Board of Supervisors,
he/she shall prepare the agenda for each meeting of the Board of Supervisors
and supply the Supervisors with all pertinent facts, documents and information
on a timely basis, so that the Board may be prepared.
(10)
He/she shall keep the Board of Supervisors informed as
to the conduct of Township affairs; submit periodic reports on the condition
of the Township finances and such other reports as the Board of Supervisors
requests; and make such recommendations to the Board of Supervisors as he/she
deems advisable.
(11)
He/she shall submit to the Board of Supervisors, as soon
as possible after the close of the fiscal year, a complete report on the finances
and administrative activities of the Township for the preceding year.
(12)
He/she shall see that all provisions of all franchises,
leases, permits and privileges granted by the Township are observed.
(13)
He/she shall recommend his suggestions to the Board of
Supervisors and carry out the decisions of the Board to employ experts, consultants
and independent contractors to perform work and to advise in connection with
any of the functions of the Township.
(14)
He/she shall attend to the letting of contracts in due
form of law, and he/she shall supervise the performance and faithful execution
of the same, except insofar as such duties are expressly imposed by statute
upon some other Township officer.
(15)
He/she shall be responsible to see that all money owed
to the Township is promptly paid and proper proceedings are initiated for
collection of all moneys owed to the Township.
(16)
He/she may be appointed by the Board of Supervisors to
be the purchasing officer of the Township. The Township Purchasing Officer
shall purchase, in accordance with the provisions of the Township Codes, all
supplies and equipment for agencies, boards, departments, committees and other
offices of the Township. The Purchasing Officer shall keep account of all
purchases and shall, from time to time or when directed by the Board of Supervisors,
make a full written report thereof. The Purchasing Officer shall recommend
his/her suggestions to the Board of Supervisors and carry out the decisions
of the Board to issue rules and regulations governing the procurement of all
municipal supplies and equipment. Both the Township Manager and the Purchasing
Officer shall be individually responsible for the enforcement of all procurement
rules and regulations.

All complaints regarding Township personnel, other than
the Township Manager, and/or regarding Township services shall be referred
to the office of the Township Manager. He/she or an officer designated by
him/her shall investigate and dispose of such complaints. The Township Manager
shall report all complaints and their disposition to the Board. All complaints
about the Township Manager shall be handled directly by the Board of Supervisors.
All complaints about the handling of complaints by the Township Manager, or
his/her designated officer, shall be handled directly by the Board of Supervisors.
If the Township Manager becomes ill or needs to be absent from the Township,
he/she shall recommend his/her interim replacement to the Board of Supervisors
who shall appoint an individual to perform the duties and responsibilities
of the Township Manager during his/her absence or disability.
Other than for purposes of inquiry, the Board of Supervisors or any
of its members shall deal with the Township administrative service solely
through the Township Manager, and neither the Board of Supervisors nor any
of its members, nor any of its committees or their members, shall give orders,
publicly or privately, to any subordinate of the Township Manager.
