A. 
All construction practices shall be in accordance with all applicable sections of the Occupational Safety and Health Act of 1970, as amended, as well as all state and local codes where applicable.
B. 
All installation of electronic equipment shall be of a permanent nature, durable, and installed in accordance with the provisions of the National Electric Safety Code and the National Electrical Code, as amended.
C. 
Antennas and their supporting structures (tower) shall be painted, lighted, erected, and maintained in accordance with all applicable rules and regulations of the Federal Aviation Administration and all other applicable state or facilities laws, codes, and regulations.
D. 
All the grantee's plant and equipment, including, but not limited to, the antennae site, head in and distribution system, towers, house connections, structures, poles, wire, cable, coax cable, fiber optic cable, fixtures, and apparatuses, shall be installed, located, erected, constructed, reconstructed, replaced, removed, repaired, maintained, and operated in accordance with good engineering practices, performed by experienced maintenance and construction personnel so as not to endanger or interfere with improvement the Township shall deem appropriate to make or to interfere in any manner with the rights-of-way of any property owner or to unnecessarily hinder or obstruct pedestrian or vehicular traffic.
E. 
Grantee shall at all times employ ordinary care and shall install and maintain in use commonly accepted methods and devices preventing failures and accidents which are likely to cause damage, injury, or nuisance to the public.
F. 
All transmission and distribution structures, poles, wires, lines, and equipment erected by the franchisee within the Township shall be so located as not to interfere with the legal rights-of-way, legal rights of any individual property owner.
G. 
In the case of disturbance of any street or paved area, the franchisee shall, at its own cost and expense in any manner approved by the Township or state, replace and restore such street or pavement area in accordance with the specification of the Township or state.
A. 
Grantee shall strictly adhere to all building, highway, and zoning codes currently or hereafter applicable to construction, operation, or maintenance of the system in the Township.
B. 
The Township shall have the right to inspect all construction or installation work performed pursuant to the provisions of the franchise and to make such tests as it shall find necessary to insure compliance with the terms of the franchise and applicable provisions of local, state, and federal law. Grantee shall reimburse Township for all associated costs.
If, at any time, during the period of franchise, the Township shall lawfully erect or alter the change of grade of any street or repair, modify, or relocate any sanitary or storm sewers or other public facilities, the franchisee, upon reasonable notice by the Township, shall remove or abandon, relay or relocate its poles, wires, cables, underground conduits, manholes, and other fixtures at its own expense.
Grantee shall not erect, for any reason, any pole on or along any street in an existing aerial utility system without advance written notice to the Township. Grantee shall exercise its best efforts to negotiate the lease of pole space and facilities from existing pole owners for all aerial construction.
Cable shall be installed underground at grantee's expense where both the existing telephone and electrical utilities are already underground. Grantee shall place cable underground in newly platted areas in concert with both the telephone and electric utilities. In the event the telephone or electric utilities are reimbursed by the Township or any agency thereof for the placement of cable underground or the movement of cable, grantee shall be reimbursed upon the same terms and conditions as the telephone or electric utilities.
A. 
All such work shall be done, insofar as practical, in such a manner as to not obstruct, injure or prevent the free use and operation of the poles, wires, conduits, conductors, pipes, or apparatus of grantee.
B. 
If any such property of grantee shall interfere with the construction or relocation, maintenance or repair of any streets or public improvement, whether it be the construction, repair, maintenance, removal, or relocation of a sewer, public sidewalk, or water main, street or any other improvement, 10 days' notice shall be given to grantee by the Township and all such poles, wires, conduits, and other appliances and facilities shall be removed or replaced by grantee in such a manner as shall be directed by the Township so the same shall not interfere with the said public work of the Township, and such removal or replacement shall be at the expense of the grantee herein. Should, however, any utility company be reimbursed for relocation of its facilities as part of the same work that requires grantee to move the facility, grantee shall be reimbursed upon the same terms and conditions as the utilities.
The franchisee in accordance with local codes shall have the authority to trim overhanging trees, after providing reasonable notice to the property owners, on street of the Township so as to prevent the branches of such trees from coming in contact with the wires and cables of the franchisee, except that at the option of the Township, such trimming may be done by it or under supervision and direction and expense of the franchisee.
In the event that it is necessary temporarily to move or remove any of the franchisee's wire, cables, poles, or other facilities placed pursuant to this franchise, in order to lawfully move a large object, vehicle, building or other structure over the streets of the Township, upon five days' notice by the Township to the grantee, grantee shall move at the expense of the person requesting the temporary removal of such of his facilities as may be required to facilitate such movements. Any service disruption provisions of this franchise shall not apply in the event of the removal of grantee's wires, cables, poles, or other facilities resulting in temporary service disruptions.
