Subdivision or development of land; construction,
opening or dedication of streets and facilities. No lot, tract, or
parcel of land shall be subdivided, and no land may be developed,
and no street, sanitary sewer, storm sewer, water main, or other facilities
in connection therewith, shall be laid out, constructed, opened or
dedicated for public use or travel, or for the use of occupants of
any building abutting or to abut on them, except in strict accordance
with the provisions of this chapter and other applicable Township
ordinances.
Sale of lots; issuance of building permits;
erection of buildings. No lot in a subdivision may be sold, no permit
to build, alter or repair any building or structure upon land in a
subdivision or land development shall be issued, and no building or
structure shall be erected in a subdivision or land development unless
and until a subdivision and/or land development plan, as applicable,
has been approved and recorded in accordance with the requirements
of this chapter and until either all of the required improvements
have been completed or their completion has been guaranteed by posting
by the subdivider or land developer of the financial security required
by the Township in an amount sufficient to cover the costs of the
required improvements, as established in accordance with the procedures
set forth in Sections 509 and 510 of the Pennsylvania Municipalities
Planning Code.
The scope of this chapter shall include all
matters over which the Township, by law, is authorized to exercise
control by enactment and enforcement of this chapter, including, but
not necessarily limited to:
A. All improvements within the tract undergoing subdivision
or land development;
B. The improvement of adjacent public facilities, including
public streets and highways giving access to the subdivision or land
development and drainage facilities on and which border and are affected
by the development upon the tract;
C. The installation, improvement or modification of off-site
improvements, including streets and highways, needed to adequately
serve the subdivision or land development; and
D. The posting of required financial security to guarantee
completion of all required public improvements described or contemplated
by Section 509 of the Pennsylvania Municipalities Planning Code, as
the same may be from time to time amended.
