Police officers of the Borough of Edgewood are hereby
authorized to use mechanical and/or electronic devices to determine
the speed of motor vehicles on the streets and roadways of the Borough,
provided that:
The device is one authorized and approved under the
laws of the Commonwealth of Pennsylvania and the regulations of the
Pennsylvania Department of Transportation.
The device is used in accordance with the policy established
by the Chief of Police, or his designees, in terms of location on
roadways and streets, personnel, written records, times and dates
for operating the device, and other pertinent administrative regulations.
The device is to be used only on public streets and
roadways which are clearly posted with speed limitations, in accordance
with the laws of the Commonwealth and the rules of the Pennsylvania
Department of Transportation.
Before each period of use, when initially setting
up the device on the roadway, the device shall be checked by use of
a police vehicle with properly certified speed calibrations; and that
such device is determined to be accurate within two miles per hour.
In addition, at the completion of the period of use, when the device
is removed or dismantled from the street or roadway, the device shall
be checked as previously set forth in this subsection and determined
to be accurate within two miles per hour.
No citation for speeding shall be issued by a police
officer using a speed timing mechanical and/or electronic device for
any speed determined by such device which is six mph, or less, in
excess of the posted speed limit for such roadway or street.
