GENERAL REFERENCES
Parks and recreation — See Ch. 124.
As used in this chapter, the following terms shall have the meanings indicated:
INTENT TO CONSUME
Includes any of the following:
A. 
Drinking from the container.
B. 
Possession with movement of the container to the mouth.
C. 
Possession with alcohol on the breath of the possessor.
D. 
Any circumstances evidencing an intent to ultimately consume on any public lands without permission.
OPEN VESSEL OR CONTAINER
Any open bottle, can or container containing liquor, beer, wine or other alcoholic beverage.

Any person who shall consume or possess with intent to consume any alcoholic beverage on any public property owned or operated by the Township of Hanover, Northampton County, Pennsylvania, is guilty of a violation of this section and shall be subject to the penalties prescribed by this chapter.

Any person who shall carry with intent to consume any opened or unopened vessel containing any alcoholic beverage while on any public property owned or operated by the Township of Hanover, Northampton County, Pennsylvania, is guilty of a violation of this section and shall be subject to the penalties prescribed by this chapter.[2]

In any case where a provision of this chapter is found to be in conflict with a provision of any other ordinance or any statute or act of the Commonwealth of Pennsylvania, existing on or after the effective date of this chapter, the provision which established the higher standard for the promotion and protection of the health and safety of the citizens of Hanover Township, Northampton County, Pennsylvania, shall prevail.
Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not less than $100 nor more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
