For the purposes of this article, the following words and phrases shall have the meaning ascribed to them in this section:
DIRECTOR OF HEALTH
The legally designated health authority of the Town of Killingworth or his authorized representative.
INDIVIDUAL SEWAGE DISPOSAL SYSTEM
A sewage disposal system, other than a public or community system, which receives either human excreta or liquid waste, or both, from one or more premises. Included within the scope of this definition are septic tank soil-absorption systems, privies and chemical-type toilets, and such other types as may be prescribed in regulations by the Director of Health.
PERMIT
A written permit issued by the Director of Health permitting the construction of an individual sewage disposal system under this article.
PERSON
Any institution, public or private corporation, individual, partnership, or other entity.

A. 
The Director of Health of the Town of Killingworth, in order to protect the health and safety of the people of the Town of Killingworth and of the general public, is authorized and directed to promulgate and amend, from time to time, regulations establishing minimum standards governing the design, construction, installation, and operation of individual sewage disposal systems. Such regulations shall establish such minimum standards as, in the judgment of the Director of Health, will ensure that the proposed site meets the minimum requirements of the regulation for seepage by actual percolation tests in locations as directed by the Director of Health or his agent and that the wastes discharged to various individual sewage disposal systems:
(1) 
Do not contaminate any drinking-water supply.
(2) 
Are not accessible to insects, rodents, or other possible carriers of disease which may come into contact with food or drinking water.
(3) 
Do not pollute or contaminate the waters of any bathing beach, pond, lake, or stream.
(4) 
Are not a health hazard by being accessible to children.
(5) 
Do not give rise to a nuisance due to odor or unsightly appearance.
(6) 
Will not violate any other laws or regulations governing water pollution or sewage disposal.
B. 
The Director of Health is authorized to promulgate such additional regulations as are necessary in his judgment to carry out the provisions of this article and to use his discretion in the application of such regulations so as to properly reflect the variations of topography and site conditions that may exist.
A. 
It shall be unlawful for any person to construct, alter, or extend individual sewage disposal systems within the Town of Killingworth unless he/she holds a valid permit issued by the Director of Health in the name of such person for the specific construction, alteration, or extension proposed. No construction shall be started on any dwelling, apartment, boardinghouses, hotels or commercial buildings nor replacement of existing sewage disposal systems be made in the Town of Killingworth unless the sewage facilities in connection with the same have been approved by the Director of Health or any inspector appointed by him/her.
B. 
All applications for permits shall be made to the Director of Health, who shall issue a permit upon compliance by the applicant with provisions of this article and any regulations adopted hereunder.
C. 
The Director of Health may refuse to grant a permit for the construction of an individual sewage disposal system where future public or community sewerage systems are reasonably available.
D. 
Applications for permits shall be in writing, shall be signed by the applicant, and shall include the following:
(1) 
Name and address of the applicant.
(2) 
Lot and block number of property on which construction, alteration or extension is proposed.
(3) 
Complete plan of the proposed disposal facility, with substantiating data, attesting to its compliance with the minimum standards of the Director of Health.
(4) 
Such further information as may be required by the Director of Health to substantiate that the proposed construction, alteration, or extension complies with regulations promulgated by the Director of Health.
E. 
A complete plan for the purpose of obtaining a permit to be issued by the Director of Health shall include:
(1) 
The number, location, and size of all sewage disposal facilities to be constructed, altered, or extended.
(2) 
The location of water supplies, water supply piping, existing sewage disposal facilities, buildings or dwellings, and adjacent lot lines.
(3) 
Plans of the proposed sewage disposal facilities to be constructed, altered, or extended.
F. 
Plans shall be prepared, sealed and signed by a professional engineer licensed in the State of Connecticut if in the opinion of the Director of Health the size or complexity of the proposed facility warrants.
G. 
The Director of Health may at his discretion submit any plan for a proposed sewage disposal facility to his agent for review and comment.
H. 
Any person whose application for a permit under this article has been denied may request a hearing thereon within 10 days of such denial and shall be granted a hearing on the matter before the Director of Health within 30 days after receipt of the request.
I. 
The fee which shall accompany the application shall be in accordance with the fee schedule adopted and amended from time to time by the Board of Selectmen.
A. 
The Director of Health is hereby authorized and directed to make such inspections as are necessary to determine satisfactory compliance with this article and regulations promulgated hereunder.
B. 
It shall be the duty of the owner or occupant of a property to give the Director of Health free access to the property at reasonable times for the purpose of making such inspections as are necessary to determine compliance with the requirements of this article and regulations promulgated hereunder.

Any person who violates any provision of this article, or any provision of any regulation adopted by the Director of Health pursuant to authority granted by this article, shall, upon conviction, be punished by a fine of not more than $250, and each day's failure to comply shall constitute a separate violation.
In any case where a provision of this article is found to be in conflict with a provision of any zoning, building, fire, safety, or health ordinance or code of this Town of Killingworth existing on the effective date of this article, the provision which, in the judgment of the Director of Health, establishes the higher standard for the promotion and protection of the health and safety of the people shall prevail. In any case where a provision of this article is found to be in conflict with a provision of any other ordinance or code of the Town of Killingworth existing on the effective date of this article which establishes a lower standard for the promotion and protection of the health and safety of the people, the provisions of this article shall be deemed to prevail and such other ordinances or codes are hereby declared to be replaced to the extent that they may be found in conflict with this article.
