The Town Board may, upon application and after public hearing held upon
notice, permit any land and the buildings and structures erected or to be
erected thereon to be used, maintained and operated for the transmission of
electrical power. In considering said application the Board will observe the
following standards:
The Town Board shall, upon granting a permit herein, impose such reasonable
and appropriate conditions, restrictions and safeguards as it may deem necessary
or desirable to promote the health, safety, morals and general welfare of
the community.
Nothing herein contained shall prevent the transmission of electrical
power for the direct consumption of users within the town along conventional
secondary street lines.
Each application shall be accompanied by a certified check in the amount
of $500 for the purpose of defraying the cost of obtaining the necessary surveys
and reports required to review the subject application. Any moneys not used
for the foregoing purpose shall be returned to the applicant within 30 days
from the date of any final determination made by the Town Board in connection
herewith.
Any person committing an offense against any provision of this chapter
shall be guilty of a violation punishable by imprisonment for a term not exceeding
15 days or by a fine not exceeding $250, or by both such fine and imprisonment.
The continuation of an offense against the provisions of this chapter shall
constitute, for each day the offense is continued, a separate and distinct
offense hereunder.
