The Town Board finds that all departments of the Town are involved in its development function and that the Town's review and supervision of new development is not being adequately compensated through existing fee structures. Studies undertaken by the Town demonstrate the significant quantities of time and effort its employees and consultants spend in such review and supervision, detracting from the Town's provision of general services to all of its citizens. The purpose of this article is to defray administrative and general governmental costs incurred during the planning and construction of new development in the Town.

A. 
In addition to any and all other fees prescribed under existing law, each unit of residential development, approved as part of a site plan or a subdivision, shall be subject to a general development fee as set forth in § 168-1, Master Fee Schedule for Land Development Applications and Permits.
B. 
In addition to any other fees prescribed under existing law, each square foot of nonresidential development, approved as part of a site plan or parking plan, shall be subject to a general development fee as set forth in § 168-1, Master Fee Schedule for Land Development Applications and Permits.
This article shall not be applicable to any residential or commercial development which has, as of the effective date of this article, already received final subdivision approval, site plan approval or parking plan approval from the Town Board or Planning Board.
