The following regulations shall apply in the
RM-MLSRO Zone only in accordance with the terms of a fully executed
mediation agreement which has been approved by the Council on Affordable
Housing and placed on file with the Brick Township Clerk.
The following are permitted uses in the RM-MLSRO
Zone:
A.Â
Multifamily inclusionary rental single-room occupancy units which do not exceed 500 square feet in size, provided that 100% of the dwelling units shall be affordable to low- or moderate-income households in accordance with Article V, Affordable Housing.
B.Â
On-site manager's office serving the multifamily development.
A.Â
The maximum density permitted shall be 26 dwelling units per acre of buildable land in accordance with § 245-3 of this chapter.
B.Â
The maximum length of any building shall be 200 feet,
and the maximum depth of any building shall be 85 feet. The minimum
distance between buildings shall be 25 feet where the facing vertical
planes contain no windows or are at a minimum placed at a fifteen-degree
angle. The minimum distance between buildings shall otherwise be 40
feet.
C.Â
No portion of any dwelling unit shall be lower than
the outside finished grade. No depressed siting shall be permitted.
Area, yard and building requirements shall be
as follows:
A.Â
Off-street parking space, together with appropriate access thereto, shall be provided on the same lot as the building it is intended to serve in accordance with the standards set forth in Article XXXV, § 245-310 et seq., except as follows:
(1)Â
The minimum number of parking spaces shall be one
per dwelling unit.
(2)Â
The minimum size for a parking space shall be nine by 18 feet to an access aisle of 25 feet between each row of parking stalls, provided that at least two feet of length overhang which does not encroach upon sidewalks or walkway is provided. Otherwise, the provisions of § 245-311J shall apply.
(3)Â
The minimum setback from parking curb face to building
shall be 10 feet. The minimum setback from the edge of the cartway
on any access drive to building shall be 15 feet.
(4)Â
The minimum width of any access drive shall be 25
feet.
A buffer zone of at least 15 feet in width in accordance with the provisions of § 245-409 shall be required on all property lines abutting nonresidential uses.

The provisions of this article are subject to the mandatory fee contribution to the Brick Township Affordable Housing Trust Fund established in Article VI.
