The Mayor and Council of the Township of Little
Falls hereby declares their intent to regulate, in a manner consistent
with the interests of the citizens of the Township of Little Falls,
the location, use and placement of construction containers.
No person, firm or corporation shall encumber
or obstruct any street, highway, public lane or alley or other public
place in the Township of Little Falls by placing therein or thereon
any type of container commonly used for the collection of debris,
as hereinafter defined, except in compliance with the provisions of
this chapter. No person, firm, company or corporation shall place
any type of container used for the collection of debris on private
property without first having complied with this article.
As used in this article, the following terms
shall have the meanings indicated:
Any debris-transfer body (i.e., dumpster, rolloff, trailer,
etc.) commonly used for the placing and/or collection of debris and
building materials during construction and/or renovation. Also included
within this definition are containers used for the storage of items,
merchandise, furniture or other such similar tangible personal property,
including but not limited to containers known as "PODS" or portable
on demand storage containers.
Discarded waste and litter originating from construction
and/or renovations to any structure and/or property.
Construction Code Official of the Township of Little Falls,
Superintendent of Public Works and/or the Division of Police.
Includes any person, firm, partnership, association, corporation,
company or organization of any kind.
The Township of Little Falls.
A.
No person shall offer, provide or place a container
for use or hire within the Township of Little Falls without having
first registered with the Construction Code Official and/or the Superintendent
of Public Works. This shall apply to containers being placed on any
street, highway, public lane or alley or other public place in the
Township of Little Falls or any container being placed on private
property of any residence, business or other private land within the
Township of Little Falls.
B.
No person, firm or corporation shall encumber or obstruct
any street, highway, public lane or alley or other public place in
the Township of Little Falls by placing therein or thereon any container
commonly used for the collection of debris as hereinafter defined
without first applying for and receiving a permit in compliance with
this chapter.
A.
Any person desiring a permit under this chapter shall
file with the Construction Code Official's office an application on
a form furnished by the same.
C.
No permit shall be issued for longer than 10 days
at any location. A permit may be renewed at said location only upon
showing of emergency circumstances.
D.
Any person, firm, company or corporation desiring a permit under this article to place a container on private property shall file with the Construction Code Official's office an application on a form furnished by the same. The permit fee shall be as set forth in Chapter 71, Fees. For containers on private property, there is no other daily charge as there is for containers set forth in § 223-31B. In the event that said container on private property remains in place for longer than 10 days, the private property owner must then reapply to the Construction Code Official and/or Superintendent of Public Works for an additional permit, at the fee set forth in Chapter 71, Fees. In the event that said homeowner fails to do so, after being notified by the Construction Code Official of its failure to renew, then and under that circumstance said private owner shall be responsible for an additional fee plus any fine as authorized by this article for the violation of said article. Every ten-day period of violation shall be deemed a continuing violation.

A.
All containers placed on public streets or roadways shall comply with the provisions of Chapter 4 of Title 39 of the New Jersey Statutes Annotated and all parking ordinances of the Township of Little Falls.
B.
The width of the street or roadway to be used shall
be limited in accordance with the traffic conditions, and the portion
so used shall meet with the approval of the Building Division and
the Police Division.
C.
No container shall be placed on any site more than
24 hours prior to commencement of work, and it must comply with the
regulations of the Board of Health and/or any fire laws.
D.
Upon removal of any container, the street or roadway
shall be swept clean of all loose debris and restored to its former
condition. Any and all damages caused by the container shall be repaired
to the satisfaction of the Superintendent of Public Works within a
period of 10 business days.
E.
The container must be covered with a tarp at night,
from 6:00 p.m. to 7:00 a.m.
F.
Any container parked at a parking meter shall reimburse
the Township for the daily meter rate.
G.
All containers must be removed from the Township's
roadways during period of snow accumulation of one inch or more or
upon the direction of the Superintendent of Public Works. Any container
that is not removed from the roadway in accordance with this provision
may be removed by the Township, in the discretion of the Public Works
Department and/or the Police Division. In the event that the Township
elects to remove any such container as authorized herein, the owner
and/or permit holder shall reimburse the Township for the reasonable
costs of removal, within 10 business days of receiving a written invoice
and demand for reimbursement.

Each container shall prominently display the
name, address and telephone number of the owner thereof.
Each container shall have both the front and
rear surfaces reflectorized for night safety in such a manner as to
indicate the height and width of the same, visible 500 feet by automobile
headlights.
