When any vehicle is parked or abandoned on any highway within the City of Rye during a snowstorm, flood, fire or other public emergency which affects that portion of the highway upon which said vehicle is parked or when any vehicle is found unattended on any highway within said City where such vehicle constitutes an obstruction to traffic or when any vehicle is parked or abandoned on any highway within said City where stopping, standing or parking is prohibited or when any vehicle has been parked more than three times within two weeks after the issuance of a parking violation appearance ticket against such vehicle at that location or when any vehicle is illegally parked or abandoned in any public place and has three or more outstanding parking violations or has unpaid parking violation fines of at least $100, said vehicle may be removed by the Police Department of the City of Rye or its duly authorized agent. The term "snowstorm" shall include not only the period of actual snowfall but such additional period thereafter as may be necessary to remove the fallen snow.
After the removal of any vehicle as provided in this article, the Police Department of the City of Rye or its duly authorized agent may store such vehicle in a suitable place at the expense of the owner. Such owner or person in charge of the vehicle may redeem the same upon payment to the Police Department of the City of Rye or its duly authorized agent of the amount of all expenses actually and necessarily incurred in effecting such removal, together with any charges for storage. The cost of removal and storage of any vehicle as herein authorized shall be a lien upon the vehicle removed and may be collected by the public sale thereof.
The Police Department of the City of Rye shall ascertain to the extent reasonably possible the owner of the vehicle or person having charge of the same and notify him of the removal and disposition of such vehicle and of the amount which will be required to redeem the same. The removal and storage charges shall be in addition to any penalty provided for violation of the provisions of this chapter or the Vehicle and Traffic Law.
No vehicle shall be parked on any highway within the City of Rye during a snowstorm, flood, fire or other public emergency after the owner or operator thereof shall have received notice by any duly authorized agent of the City of Rye that parking in said highway is prohibited or to remove said vehicle from said highway.
