This chapter may be cited as the "Londonderry Township Refuse Disposal Ordinance."
A. 
Definitions. The following words, as used in this article, shall have the meanings hereby ascribed thereto, unless the context clearly indicates a different meaning:
ASHES
Residue from the burning of coal, coke or other combustible material.
GARBAGE
All table refuse, animal and vegetable matter, offal from meat, fish and fowls, fruits, vegetables and parts thereof, and other articles and materials ordinarily used for food which have become unfit for such use or which are for any reason discarded.
HAZARDOUS WASTE
Any garbage or refuse, or any combination of solid wastes, which because of its quantity, quality, concentration or physical, chemical or infectious characteristics may cause or significantly contribute to an increase in mortality in either an individual or the total population, or an increase in serious irreversible or incapacitating reversible illness; or pose a substantial present or future threat or potential hazard to human health or the environment when improperly treated, stored, transported, or disposed of or otherwise managed.
PERSON
Any individual, partnership, association, corporation, institution, cooperative enterprise, trust, municipal authority, federal government or agency, commonwealth institution or agency or any other legal entity whatsoever which is recognized by law as a subject of rights and duties. In any provision of this article prescribing a fine, imprisonment or penalty, or any combination of the foregoing, the term "person" shall include the officers and directors of any corporation or any other legal entity having officers and directors.
REFUSE
A general term meaning all solid waste and material which is discarded, including garbage, ashes and noncombustible waste.
RESIDENT
Any person that owns, leases or occupies a property located in Londonderry Township used as a residence.
TRANSFER STATION
The Londonderry Township Refuse Transfer Station established herein.
B. 
Word usage. In this article, the singular shall include the plural and the masculine shall include the feminine and neuter.
A. 
In order to meet the needs of the residents of Londonderry Township, the Township hereby provides facilities for the collection, storage and removal of refuse generated by residents of the Township.
B. 
The location provided by the Township shall be known as the "Londonderry Township Refuse Transfer Station" and shall consist of a stabilized stone or paved area, with access from a public road, upon which is located a refuse container that can be closed when not in use and which, at the appropriate time, can be hauled to a local landfill for disposal of its contents.
C. 
It shall be unlawful for any person to deposit or to permit to accumulate any ashes, garbage, or any other refuse materials upon either public or private property, including public roads of the Township, except when contained in appropriate containers for scheduled collection by a contract service.
A. 
The transfer station shall be open and available for delivery of refuse on a schedule prominently displayed at the entrance to the transfer station. Entering or depositing refuse within the transfer station property at any time other than the posted hours of operation is forbidden and shall be deemed a violation of this chapter.
B. 
All persons using the transfer station shall deposit their refuse in the container provided for that purpose and not at any other location.
C. 
No dead animals shall be delivered to or deposited at the transfer station.
D. 
No hazardous wastes shall be delivered to or deposited at the transfer station.
E. 
No construction waste, including but not limited to shingles, sheetrock, pipes, or furniture, shall be delivered to or deposited at the transfer station.
F. 
No refuse generated on or by a commercial or industrial property may be delivered to or deposited at the transfer station.
G. 
No refuse from properties located outside of Londonderry Township shall be delivered to or deposited at the transfer station.
H. 
No person shall burn any refuse at the transfer station.
A. 
Residents of Londonderry Township who wish to use the transfer station shall apply for a permit from the Township Office prior to utilizing the transfer station.
B. 
A permitting fee shall be charged as provided for in a schedule of fees as adopted by resolution of the Board of Supervisors.
C. 
It is the responsibility of the manager of the transfer station to determine that the person delivering the refuse has obtained a permit. The manager may request the person delivering refuse to the transfer station to provide positive identification.
D. 
Persons delivering refuse on behalf of a resident shall provide to the manager a signed written request for such service from the resident; however, commercial collectors are specifically prohibited from delivering or depositing refuse at the transfer station.
Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
