Whenever this chapter shall set forth any time for an act to be performed
by or on behalf of the grantee, such time shall be deemed of the essence and
any failure of the grantee to perform within the time allotted shall always
be sufficient ground for the Township to invoke an appropriate penalty including
possible revocation of the franchise.
In any controversy or dispute under this chapter, the law of the Commonwealth
of Pennsylvania shall apply.
Any person who violates or permits a violation of this chapter, upon
being found liable therefor in a civil enforcement proceeding, shall pay a
fine of not more than $600, plus all court costs, including reasonable attorney's
fees, incurred by the Township in the enforcement of this chapter. No judgment
shall be imposed until the date of the determination of the violation by the
District Justice and/or Court. If the defendant neither pays nor timely appeals
the judgment, the Township may enforce the judgment pursuant to the applicable
rules of civil procedure. Each day a violation exists shall constitute a separate
offense. Further, the appropriate officers or agents of the Township are hereby
authorized to seek equitable relief, including injunction, to enforce compliance
herewith.

A. Grantee shall provide complimentary video services at the expanded
basic level or equivalent to all municipal buildings, elementary schools,
secondary schools and private schools.
B. Grantee shall provide complimentary high-speed Internet service
to all municipal buildings, elementary schools, secondary schools and private
schools.
