The appropriate officials of the Township are
directed to take such action as may be necessary to amend the Official
Plan of Skippack Township to implement the purposes of this chapter.
The Township reserves the right to amend or
modify this chapter and/or any article or any parts thereof at any
time or from time to time.
This chapter shall not be construed or interpreted
as imposing upon the Board or its officials or employees any liability
or responsibility for damages to any property; or any representation
or warranty that any system, installation or portion thereof that
is constructed or repaired under orders and inspections required by
this chapter will function properly. In addition, neither the Board
or any of its officials and employees charged with the enforcement
of this chapter, if acting in good faith and without malice in the
discharge of their duties, shall be personally liable for any damage
that may occur to persons or property as a result of performing or
not performing any act required by this chapter.
It is the intent of the Township that this chapter
shall not repeal any building or plumbing code or sewage management
ordinance lawfully adopted by the Township. Whenever the provisions
of this chapter, or rules and regulations of the Board being enforced
by this chapter, are in conflict with or at variance with any lawfully
adopted building or plumbing code, or sewage management resolutions
adopted by the Board, the more restrictive requirements shall govern.
The provisions of this chapter shall be severable,
and if any provisions shall be held to be unconstitutional, invalid
or illegal, by any court of competent jurisdiction, such decision
shall not affect the validity of any of the remaining provisions of
this chapter. It is hereby declared as legislative intent that this
chapter would have been enacted had such unconstitutional, invalid
or illegal provisions not been included herein.
