A. 
Definitions. The following words and phrases shall be construed through this Article VIII to have the following meanings:

ALLEY
The entire width between property lines or other boundary lines of every way or place of which any part is open to the public for purposes of vehicular travel as a matter of right or custom.
HIGHWAY
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. The term includes a roadway open to the use of the public for vehicular travel on grounds of a college or university or public or private school or public or historical park.
MOTORCYCLE
A motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground.
MOTOR VEHICLES
A vehicle which is self-propelled except one which is propelled solely by human power.
SNOWMOBILE
An engine-driven vehicle of a type which utilizes sled-type runners, or skis, or an endless belt tread or any combination of these or other similar means of contact with the surface upon which it is operated. The term does not include any farm tractor, highway or other construction equipment, or any military or law enforcement vehicle.
STREET
A highway, other than an alley, within the corporate limits of a political subdivision.
VEHICLE CODE
The Pennsylvania Vehicle Code, 75 Pa.C.S.A. § 101 et seq., as amended and supplemented from time to time.
B. 
Operation of defined vehicles.
(1) 
No person shall operate any motorcycle, motor vehicle or snowmobile, on any alley, street or highway within the Borough of Kane, unless said vehicle bears a valid registration plate; and a current inspection sticker; and the operator thereof is in the possession of a valid drivers license, or in the case of a snowmobile operated by a person under 16 years of age, a snowmobile safety certificate.
(2) 
Any person, firm or corporation who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $300, together with costs of prosecution, or to imprisonment for a term not to exceed 30 days.
C. 
Snowmobile routes designated.
(1) 
No person shall operate a snowmobile on any alley, street or highway within the boundaries of the Borough of Kane, unless said alley, street or highway has been designated as a "snowmobile route" pursuant to appropriate action by the Borough Council (see § 242-58 hereof) in accordance with the provisions of the Pennsylvania Vehicle Code.
(2) 
Any person, firm or corporation who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of not less than $10 nor more than $50, or to imprisonment for a term not to exceed 10 days for the first offense. For second and subsequent offenses the fine will be not less than $25 nor more than $100 plus costs of prosecution, or imprisonment for a term not to exceed 30 days.

Snowmobile routes. Pursuant to the Vehicle Code, 75 Pa. C.S.A., § 7722, the following streets are hereby designated as snowmobile roads:

Such streets designated as snowmobile roads shall be shared with vehicular traffic.
Except to cross streets or highways as permitted by the Vehicle Code, no snowmobile shall be operated on any street within the Borough of Kane except those herein designated as snowmobile roads.
A. 
No snowmobile shall be operated within the Borough of Kane at a speed of more than 10 miles per hour.
B. 
Snowmobiles shall be operated as close to the curb as possible, or on the berm of a street that has no curb, and in the direction of vehicular traffic.
No snowmobile shall be operated within the Borough of Kane before the hour of 6:00 a.m. No snowmobile shall be operated in the Borough of Kane after 11:00 p.m. on Monday, Tuesday, Wednesday, Thursday, Friday and Sunday or after the hour of 1:30 a.m. on Saturday.
Streets designated as snowmobile roads shall be used only for the purpose of entering or leaving the Borough of Kane in order to gain access to snowmobile trails existing beyond the borough limits and for no other purpose.
Every snowmobile within the limits of the Borough of Kane shall have affixed to it a permit of blaze orange color at least one foot square mounted six feet above the track of the snowmobile.
Any person who shall violate any provision of this Article VIII shall, upon conviction before a District Justice, be subject to a fine of not less than $10 nor more than $300 or, in default of payment thereof, be sentenced to the McKean County Jail for a period not to exceed 30 days.
