Unless otherwise expressly stated, the following words
or phrases shall be construed throughout this chapter to have the
meaning herein indicated:
AGRICULTURE or AGRICULTURAL
The bona fide use of a parcel of land of five acres or more
for the cultivation of land, raising of poultry and livestock or similar
agrarian activity and the related buildings, structures and appurtenances
necessary to carry out the aforementioned activities.
APARTMENT BUILDING
A single residential structure designed and constructed to
contain three or more separate dwelling units regardless of the internal
arrangement of such units or the ownership thereof.
BAR/TAVERN
An establishment licensed by the state for the sale of alcoholic
beverages that derives 75% or more of the establishment's gross revenue
from the on-premises sale of alcoholic beverages for on- and off-premises
consumption as established by the P.L.C.B.

BLOCK
An area of land surrounded on all sides by streets, railroads
or other rights-of-way, regardless of size or shape of such land or
the number of such lots thereon.
BOARDINGHOUSE/BED-AND-BREAKFAST
A dwelling in which, for compensation, lodging or meals,
or both, are furnished to not more than nine guests.

BUFFER ZONE
A strip of land, or a minimum width of five feet planted
with evergreen shrubs or trees, a minimum of four feet high at the
time of planting, spaced 10 feet apart, for the purpose of providing
a screen.
BUILDING
A structure having one or more stories and a roof, designed
primarily for the shelter, support or enclosure of persons, animals
or property of any kind.
BUILDING, ACCESSORY
A building detached from and subordinate to a main building
on the same lot and used for purposes customarily incidental to the
use of the main building, whether situated on the same lot with a
principal building or not.
BUILDING, ACCESSORY (STAND ALONE)
A building detached from and subordinate to a main building
not located on the same lot and used for purposes customarily incidental
to the use of the main building.

CARE HOME
Includes rest and nursing homes, convalescent homes and boardinghouses
for the aged, established to render domiciliary care for chronic or
convalescent patients, but excludes child care homes or facilities
predominantly for the care of mentally retarded, mentally disturbed,
epileptic, alcoholic and drug addicted patients.
CHILD CARE HOME
Private, public or semipublic facility licensed for the housing
and care of children.
COMMUNITY USE
A facility or land used for public recreation, safety, cultural
or educational activities, which is owned and managed by a public,
semipublic or nonprofit organization.
DWELLING UNIT
A building or portion thereof arranged or designed for occupancy
by not more than one family for living purposes and having cooking
facilities.
ESSENTIAL SERVICES
Facilities and structures owned or maintained by a government,
a public agency or a public utility company for the purpose of and
directly necessary for rendering or providing communication, electric,
gas, sewer, water or comparable service of a public utility nature
and, in fact, used in the rendition of such service.
FARM
A parcel of land of five acres or more on which bona fide
agricultural and related uses are conducted as specified in "agriculture."
FRONTAGE
That dimension of a lot measured along the front street line
thereof; or if said front street line is curved, along the chord of
the arc. The shorter street line of a lot abutting on more than one
street shall be deemed to be the front street line thereof, regardless
of the location of the principal entrance of a building on the lot.
HOME OCCUPATION
An occupation or activity that shall be conducted entirely
within the confines of the property by an owner/occupant of the property;
the amount of floor area used for such occupation shall not exceed
25% of the total floor area of the property; no more than three nonresidents
shall be employed; a sufficient number of paved off-street parking
spaces shall be provided as deemed necessary by the Zoning Hearing
Board. Articles sold or offered for sale shall be limited to those
that are necessary and incidental to the home occupation; there shall
be no exterior display or no sign larger than two feet by three feet
(unlit), exterior storage of materials must be enclosed (covered)
and no other exterior indication of the home occupation; no potentially
dangerous effluent from operations shall be discharged; such home
occupations shall be incidental or secondary to the use of the property
as a residence.

HOME OFFICE
An office, studio or room used for the rendering of a service
or advice for a fee when no other persons are engaged in the occupation
in excess of two employees of the principal practitioner; the architectural
style shall not be changed from its residential character; no outside
storage or display shall be allowed; and the use shall not generate
continuous traffic to the site.
HOSPITAL
Any institution receiving in-patients and rendering medical
care, including those wherein mentally retarded, mentally disturbed,
epileptic, alcoholic, drug addicted, chronically ill and physically
handicapped patients are treated or cared for.
INDUSTRIAL PARK
A tract of land subdivided and developed for industrial use
according to a comprehensive development plan.
JUNKYARD
The use of any space, whether inside or outside a building,
for the storage, keeping, abandonment, salvage or sale of junk, scrap
metals or other scrap materials, including the dismantling, demolition
or abandonment of one or more automobiles or other vehicles or machinery
or parts thereof, whether for private or business purposes, and whether
in connection with another business or not.
LOT
Land occupied or to be occupied by a building and any accessory
building with the open spaces appurtenant to such building or group,
and having its principal frontage on a street.
LOT, AREA
The total horizontal area included within lot lines.
LOT, CORNER
A lot at the junction of and abutting on two or more intersecting
streets.
LOT LINE
Any boundary line of a lot on a legally recorded plat.
LOT LINE, REAR
The lot line that is generally opposite the lot line along
the frontage of the lot; if the rear line is less than 10 feet in
length or if the lot comes to a point at the rear, the rear lot line
shall be deemed to be a line parallel to the front lot line, not less
than 10 feet long, lying wholly within the lot, and farthest from
the front lot line.
LOT, WIDTH
The width of a lot along a line parallel to the frontage
thereof and lying a distance therefrom equal to the required setback
on said lot required by this chapter or of a greater setback line
if established.
MIXED USE
Dwelling(s) in the same building with a permitted commercial,
business, educational or residential use.

MOBILE HOME
A transportable, single-family dwelling intended for permanent
occupancy, office or place of assembly contained in one unit, or in
two units designed to be joined into one integral unit capable of
again being separated for repeated towing which arrives at a site
complete and ready for occupancy except for minor and incidental unpacking
and assembly operations and constructed so that it may be used without
a permanent foundation.
MOBILE HOME PARK
A parcel of land under single ownership which has been planned
and improved for the placement of mobile homes for nontransient use,
consisting of two or more mobile lots.
MOTEL
Any building or portion thereof containing sleeping accommodations
in five or more rooms, whether such establishment is designed as a
hotel, motor hotel or otherwise.
NONCONFORMING BUILDINGS OR USE
A building or use lawfully existing at the time of adoption
of this chapter and which does not conform with the use regulations
of the district in which it is located.
PLAT
The map or plan of a subdivision or land development, whether
preliminary or final.
PRIVATE CLUB
An association for civic, social, cultural, religious, literary,
political, recreational or like activities, operated for the benefit
of its members and not open to the general public.
RESIDENCE
A building containing only dwelling units. The term "residence"
or any combination thereof shall not be deemed to include hotel, boardinghouse,
rooming house, motel, hospital or other accommodations used for transient
occupancy or mobile residences.
RESTAURANT
Any establishment at which food and/or beverages are sold
for consumption on the premises. However a snack bar or refreshment
stand at a public or nonprofit community swimming pool, playground
or park, operated solely for the convenience of patrons of the facility,
shall not be deemed to be a restaurant.
RESUBDIVISION
A legal subdivision which has been altered by changing of
a line, bearing or other measurement which either reduces or enlarges
the number of lots or size of lot(s) originally created, and which
is subsequently platted and recorded in a legal manner.
SCHOOL, NURSERY
Any place, however designated, operated for the purpose of
providing training, guidance, education or care for four or more children
separated from their parents or guardians during any part of the day,
including kindergartens, day nurseries and day care centers.
SETBACK LINE
A line drawn through the point of a building nearest to the
center line of the street, or lot line from which the setback line
is measured and lying parallel thereto. The term "required setback"
means a line beyond which a building is not permitted to extend under
the provisions of this chapter establishing minimum depths and widths
of yards. An interior lot or an assembly of lots to form an interior
lot, with frontage on two streets, shall have a required setback equivalent
to a front yard on each street.
SHOPPING CENTER
A group of commercial establishments planned, developed and
owned and managed as a unit with on-site parking.
SPECIAL EXCEPTION
A permission or approval granted by the Zoning Hearing Board
for a use not permitted by right in a zoning district. The use must
be listed in the district regulations as permitted by special exception.
The Zoning Hearing Board may attach such reasonable conditions and
safeguards, in addition to these expressly required, as it may deem
necessary to implement the purposes of this chapter.
STREET
Includes street, avenue, boulevard, road, highway, lane,
alley, viaduct and any other ways used or intended to be used by vehicular
traffic or pedestrians, whether public or private.
STRUCTURE
Any man-made object having an ascertainable stationary location
on or in land or water, whether or not fixed to the land.
SUBDIVISION
The division or redivision of a lot, tract or parcel of land
by any means into two or more lots, tracts, parcels or other divisions
of land including changes in existing lot lines for the purpose, whether
immediate or future, of lease, transfer of ownership or building or
lot development; provided, however, that the division of land for
agricultural purposes into parcels of more than 10 acres, not involving
any new street or easement of access, shall be exempted.
TOWNHOUSE
A single-family dwelling forming one of a series of attached
single-family dwellings, separated from one another by a party wall
without doors, windows or other provisions for human passage or visibility
and sound transmission through such party walls, extending from the
cellar floor and/or foundation to the highest point of the roof, along
the dividing lot line; and separated from any other building or structure
by space on all other sides; which may be offered for sale or rental.
TRAVEL TRAILER
A portable vehicular structure designed as a temporary living
unit for travel, recreational and vacation uses.
USE, PERMITTED
Those uses specifically listed in this chapter as uses permitted
by right or by special exception.
USE, PRINCIPAL
The principal purpose for which a lot or a building is designed,
arranged, intended, occupied or maintained.
YARD
An open space on the same lot with a building or a building
group, lying between the building or building groups and the nearest
lot line, and unoccupied and unobstructed by any structure from the
ground upward.
YARD, FRONT
A yard extending across the full width of the lot and lying
between the front line of the lot and the building or building group.
YARD, REAR
A yard extending across the full width of the lot and lying
between the rear line of the lot and the building or building group.
YARD, SIDE
A yard between the side line of the lot and the building
or building group and extending from the front yard to the rear yard,
or, in the absence of either yards, from the front to the rear lot
line.
