The Town of Farmington does hereby establish an Economic Development
Commission pursuant to the provisions of C.G.S. § 7-136, to be known
and designated as the "Farmington Economic Development Commission," hereinafter
referred to as the "Commission."

The Commission shall consist of seven members, who shall serve without
compensation. The President of the Farmington Chamber of Commerce or a designee
of that organization shall serve as one of the members of the Commission.

A. Except for the representative of the Farmington Chamber
of Commerce, the members of the Commission and any vacancies in the membership
of the Commission shall be appointed by the Town Manager upon recommendation
of the Town Council.
B. Each appointed member of the Commission shall serve for
a term of two years, which term shall commence on October 1 of each year;
provided, however, that three of the appointees shall be appointed for terms
expiring on September 30, 1994, and three of the appointees shall be appointed
for terms expiring on September 30, 1995.
An annual appropriation for the expenses of the Commission may be made
upon application by the Commission to the Town Manager pursuant to the provisions
of Article IX of the Charter of the Town of Farmington, as revised effective
July 1, 1965; provided, however, that in no event shall such appropriation
exceed of 1/20 of 1% of the last completed grand list of the taxable property
in the Town of Farmington.

A. Within thirty days after October 1 of each year, the
members of the Commission shall meet and elect from among the appointed members
a Chairman and other appropriate officers.
B. The office of the Town Planner shall provide administrative
support to the Commission.

The membership of any person who is absent from three regular meetings
during any six-month period shall terminate as of the time the third such
absence occurs, and the vacancy shall be filled by the appointing body, unless
such absences are waived by the Chairman of the Commission because of illness
or other extenuating circumstances. The Chairman of the Commission shall notify
the Town Manager promptly after the third such absence occurs.
A business development incentive program is established to be exercised
at the sole discretion of the Council upon recommendation of the Economic
Development Commission acting pursuant to the limitations as set forth herein.
The incentives to be considered by the Council upon recommendation by the
Economic Development Commission shall include the waiver of Town-imposed fees
and entering into agreements with persons owning or proposing to acquire an
interest in real property in the Town to fix the assessment of real property
as authorized by C.G.S. Section 12-65b.
The Council shall only consider and act upon the offer of incentives
to businesses and industries in the Town when such incentives have been recommended
to the Council by a 2/3 vote of the total membership of the Economic Development
Commission, after the Commission has concluded that such an incentive is in
the best long-term, economic interest of the Town.
