This Article shall hereinafter be referred to
and cited as the "Traffic Lane Closure Regulations of the City of
South Pasadena."
The purpose of this Article is to promulgate
regulations controlling the closure of traffic lanes on public highways,
streets and alleys within the corporate limits of the city so as to
effectively manage the flow of vehicular traffic and to prevent circumstances
inimical to the health, welfare and safety of the traveling public
and to all those who would suffer an adverse impact from obstructed
traffic flow conditions.

This chapter shall supplement existing Florida
Law regarding traffic control contained in Chapter 316 of the Florida
Statutes and shall implement Florida Statute 316.2045(3). This chapter
shall apply to all roads within the City of South Pasadena.

It shall be unlawful, without a city lane closure
permit, for any person or persons to willfully obstruct the free,
convenient and normal use of any public street within the city limits
by any means, including but not limited to the placement of cones,
barriers or a flagman in a traffic lane. In the case of an emergency,
authorized personnel shall have the authority to close lanes without
a permit. For purposes of this article, the word "emergency" shall
mean unanticipated repair work needed to restore any of the following:
power, potable and reclaimed water, sanitary and storm sewers, telephone,
cable television, streetlights, traffic signals and roadways. Authorized
personnel includes city employees and contractors retained by the
city, utility companies and other government agencies which have a
franchise or interlocal agreement with the city to provide the services
enumerated herein. In addition, any recognized law enforcement, Fire
Department or other emergency management agency may close lanes for
public safety purposes without a city permit.

Lane closure permits will be issued when the
closure is needed to accomplish a public purpose, and the detour proposed
is consistent with the standards set forth in the United States Manual
of Uniform Traffic Control Devices. Public purposes shall include
the maintenance or installation of a public utility, road, sidewalk
or median.

A. Administration. Administration of the permit approval
process shall be the responsibility of the Department of Public Safety.
All permits must be approved by either the Commissioner of Public
Safety or the Director of the Department.
B. Application. Except as provided herein, applications
shall be filed at least 10 days prior to the planned lane closure.
The application form, as reproduced within this subsection, shall
be completed in its entirety before permit consideration by the Department
will be given. In cases where the Florida Department of Transportation
has issued a permit for a lane closure, in lieu of an application,
the applicant shall file a copy of the permit with the Department
of Public Safety a minimum of three days prior to the lane closure.

C. Permit.
|
Permits for traffic lane closure shall be issued to applicants meeting the criteria set forth in § 189-23 by the Department on a form reproduced within this subsection.
