A. 
No structure shall be moved from one location within the City of Brigantine to another or moved into the City of Brigantine from a location outside the City of Brigantine unless the procedures set forth in this chapter are complied with by any person seeking to apply for permission to move any structure.
B. 
Persons subject to this chapter include building owners (either in place or in transit), moving contractors and their agents, servants and employees.
As used in this chapter, the following terms shall have the meanings indicated:
LOCATION
A discreet tax lot, as shown on the Tax Maps of the City of Brigantine.
STRUCTURE
Any structure which comes under the jurisdiction of the Uniform Construction Code of the State of New Jersey.

Any person seeking to move any structure shall apply to the Construction Official of the City of Brigantine, or his designated representative, for a permit to move structures, which permit is authorized under this chapter.
The requirements for issuance of a permit shall include, in an application made by the structure owner and by any contractor sought to be employed by such owner, the following:
A. 
Fourteen days' advance notice of any move.
B. 
A completed application for a demolition permit for the site from which the structure is to be moved, unless it's a new modular-type construction.
C. 
A completed new site foundation and construction permit application (all applicable subcodes) treating the proposed structure as new construction using partially used materials, where applicable.
D. 
A letter of approval from Atlantic Electric, South Jersey Gas, Brigantine Water Department, Brigantine Sewer Department, the cable franchisee in the City of Brigantine, New Jersey Bell Telephone, the Brigantine Police Department and the Brigantine Fire Department. The letter shall make reference to a planned route of travel, dates and times of travel.
E. 
Insurance certificate, showing owner's and contractor's liability insurance in an amount not less than $1,000,000 each, along with workers' compensation insurance. Such insurance certificate shall name the City of Brigantine as an additional insured.
F. 
Payment of the required permit fee.
G. 
Payment of the required escrow deposit to the City of Brigantine in the amount set forth in this chapter.
H. 
A complete description of the structure sought to be moved, including height of the structure, width and length, and any other information deemed to be necessary to evaluate the application.
I. 
A complete description of the planned times for and routes of travel.
Within five working days after the submission of the application, the Construction Official of the City of Brigantine, after consultation with the Superintendent of Public Works, the City Engineer, the Chief of Police and any other City official reasonably necessary to evaluate the application, shall advise the persons making the application as to whether it is approved and under what conditions the move shall take place. The advice shall include a written description of any limitations placed on the move, along with a listing of anticipated costs from the City of Brigantine. Such costs shall list the number of police, fire, public works and other City employees necessary to monitor the move and to protect the public safety. Costs shall be charged as set forth in this chapter.
Not less than 48 hours prior to the move, the applicant shall deliver notices to the Brigantine Police Department, advising residents along the route of travel from its place of beginning to the place of its installation that the movement of a structure will be taking place. The notice shall request all vehicles be off the street not less than three hours prior to the start of the move, and said notice shall clearly and specifically identify the name of the owner of the structure while it is in transit, the owner of the structure when it is placed on the property of destination (if different) and the name of the contractor responsible for the move. As to all persons identified, the complete business address and telephone number of the company or person shall be listed. If a corporation, the registered office of the corporation, along with the business address, shall be shown.
To assist in the accomplishment of the move, the City of Brigantine will assign not less than two public works employees and not less than two Police Department officers. Any additional employees or services as are determined to be necessary to ensure the public safety will be assigned by the City of Brigantine. All costs incurred, in excess of the minimum services described below in the fee portion of this chapter,[1] will be charged to the applicant at the rates which are determined by the superintendent or head of the applicable department.

The applicant shall provide to the City of Brigantine a hold-harmless agreement, in addition to any insurance requirement set forth in this chapter. That agreement shall provide that the persons applying for a moving permit shall agree to hold the City of Brigantine harmless and indemnify it for all costs, losses and expenses incurred, of any kind, and defend the City of Brigantine in the event of any claim arising out of the moving activity. Any damage done to City property or any public facility shall be repaired according to the directions of the appropriate official of the City of Brigantine. Any repairs done by the City itself will be charged to the person applying for the permit.
Any structure subject to this chapter shall comply in all respects to the Uniform Construction Code[1] and applicable subcodes in effect in the City of Brigantine. All minimum room sizes and installations shall conform to those applicable codes. The placement of any structure on a new location shall comply in all respects with Chapter 198, Land Use.

A. 
Upon the installation of any structure on a site in accordance with this chapter, such structure shall immediately be secured, with all openings such as windows and doors closed. In the event of damage to said structure necessitated by the move or resulting in any manner from its movement, such damage shall immediately be repaired, and no unsightly structures or structures with broken or improperly secured areas or facilities will be permitted.
B. 
All siding and exterior covering must be completed in not less than 90 days. The escrow fee deposited pursuant to § 264-11E of this chapter shall be retained in full by the City of Brigantine until certification by the Construction Official that the requirements of this section have been fulfilled.

The fees as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, shall be charged for movement of structures in the City of Brigantine as follows:
A. 
For a moving permit application, which includes costs of public works and police survey.
B. 
For employee services, which include two police and two public works' employees and appropriate equipment during the move.
C. 
For additional employee services, per hour, per officer or public works' employee, for Police Department notification along the route and any additional services or labor which must be provided.
D. 
Any costs, losses or damage incurred shall be at the actual cost of replacement, plus City employee time required for the repair.
E. 
For an escrow fee, to be deposited with the City of Brigantine, from which all costs other than the application fee shall be deducted.
A. 
Any person or entity which violates this chapter shall be cited on complaint by the appropriate official of the City of Brigantine and tried in the Municipal Court of the City of Brigantine or in such other court which has jurisdiction.
B. 
Any person or entity which violates this chapter shall, upon conviction, be punished by a fine not to exceed $1,000 or by imprisonment not to exceed 90 days, or both.
