Pursuant to the provisions of N.J.S.A. 2B:12-1
et seq., as amended and supplemented, there is established within
the Borough a Municipal Court.
The name of the Municipal Court so established
shall be "Municipal Court of the Borough."
The Municipal Court shall have a Seal, which
shall bear the impress of the name of the Court.
There shall be a Judge of the Municipal Court,
who shall be known as the "Judge of the Municipal Court." He shall
be appointed by the Mayor with the advice and consent of the Borough
Council. He shall serve for a term of three years from the date of
his appointment and until his successor is appointed and qualified.
The Municipal Judge shall receive such annual
salary or compensation as the Mayor and Council may fix and determine.

The Mayor and Council may, pursuant to law,
provide for and appoint an Administrator and any other necessary clerical
or other assistants for the Municipal Court, and provide for their
compensation.

Any and all applications in the Franklin Lakes
Municipal Court for the assignment of a Public Defender shall be processed
only upon the payment of a two-hundred-dollar fee by the applicant.
In accordance with the guidelines promulgated by the Supreme Court,
the Municipal Court may waive any required application fee, in whole
or in part, only if the Court determines, in its discretion, upon
a clear and convincing showing by the applicant that the application
fee represents an unreasonable burden on the person seeking representation.
The Municipal Court may permit a person to pay the application fee
over a specific period of time not to exceed four months.
