[Adopted 2-14-1990 by Ord. No. 893 as Ch. X of the 1988 Code]
This chapter is enacted to establish rules and regulations of the public lands and parks of the Borough and to establish hours for use of the public lands and parks owned by the Borough.
As used in this chapter, the following terms shall have the meanings indicated:
PERMIT
Any written license issued by or under the issuing authority, permitting the performance of a specified act or acts.
PUBLIC LANDS AND PARKS
Any lands situated in the Borough now owned or hereafter acquired by or under the jurisdiction of the Borough or any lands so designated.
SOLICITING
Selling goods or services by sample or taking orders for future delivery with or without accepting advance payment for the goods, or seeking any form of contributions.
VENDING
To sell, to dispose of by any sale or to trade.
In the interpretation of this chapter and all succeeding park ordinances, the provisions shall be construed as follows:
A. 
Any requirement or prohibition of any act shall respectively extend to and include the causing and procuring, directly or indirectly, of such act.
B. 
No provision hereof shall make unlawful any act necessarily performed by any officer or employee of the Borough in line of duty or work as such, or by any person, his agent or employees in the proper and necessary execution of the terms of any agreement with the Borough.
C. 
Any act otherwise prohibited by law or local ordinance shall be lawful if performed under, by virtue of and strictly within the provisions of a permit so to do, and to the extent authorized thereby.
No person shall post, paint, affix, distribute, hand out, deliver, place or leave about any bill, billboard, placard, ticket, handbill, circular or advertisement; display any flag, banner, transparency, target, sign, placard, blimp, balloon, airplane, searchlight or any other matter for advertising purposes or operate any musical instrument or drum for advertising purposes or for the purpose of attracting attention to any exhibition, show, performance or other display without the permission of the Borough.

No person, group or organization shall solicit alms or contributions for any purpose without the permission of the Borough.

All statutes, regulations, ordinances and other applicable rules and regulations regarding disorderly persons shall apply herein and shall be enforced as part of the terms and conditions of this chapter, and any person in violation thereof shall be subject to punishment as provided by law.
No person shall bring into or have in the parks any explosive, including any substance, compound, mixture or article having properties of such a character that alone or in combination or contiguity with other substances or compounds may decompose suddenly and generate sufficient heat, gas or pressure or any or all of them to produce rapid flaming or combustion or administer a destructive blow to surrounding objects without the approval of the Borough.
All statutes, regulations, ordinances and other applicable rules and regulations regarding firearms, weapons and tools are incorporated herein and are enforceable within the terms and conditions of this chapter, and any person in violation thereof shall be subject to punishment as provided by law.

No person shall sell or offer for sale any object or merchandise or any other thing, whether corporeal or incorporeal, except pursuant to a permit.
A. 
No person shall kindle, build, maintain or use a fire except in places designated for such purpose.
B. 
Every fire shall be continuously under the care and direction of a competent person from the time it is kindled until it is extinguished.
C. 
Only charcoal, charcoal lighters or fuel provided by the park will be permitted.
D. 
No cigar, cigarette or lighted match shall be discharged carelessly or in a manner which may start a fire.
No person shall play any game of chance or have possession of any instrument or device for gambling.
No person shall:
A. 
Cut, break, deface, defile or misuse any building, playground, equipment, fence, tree, bush, plant or turf or other thing belonging to a park or playground, or any part thereof.
B. 
Destroy, remove, carry away, or have possession of any building, playground equipment, fence, tree, bush, plant, turf or other thing belonging to a park or playground, or any part thereof.
C. 
Cut into, destroy or remove any of the curbing, roadways, sidewalks or paths within a park or playground without written permission.

Public lands and parks owned by the Borough shall be open for use from dawn to dusk, except that facilities with lighting, including, but not limited to, Muni fields, Pulis Avenue fields, Old Mill Woodlands tennis courts and dog park, shall be open for use during the hours that the lights are on.

Signs setting forth the hours that the public lands and parks will be open shall be posted in at least one location wherever space shall so permit.
A permit will be necessary for use of public lands and parks during hours other than as established herein. Such permit or permits authorizing such use or uses of the public lands or parks shall be granted in writing by the appropriate public body or official of the Borough as designated by the Mayor and Council upon application to the appropriate public body or official. All conditions of the permit approved must be adhered to, and any falsifications or violation of the terms and conditions or rules and regulations shall constitute grounds for its revocation by the public body or official issuing the permit.

In accordance with § 157-11 of the Borough Code, dogs are prohibited from running at large and prohibited in playground areas and on playing fields within the Borough.
Any person violating any provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $200 for each offense or by imprisonment for a term not exceeding 30 days, or both, plus the cost of any damages.
