[Adopted by Ord. No. 913 (Sec. 14-6 of the 1988 Code)]
As used in this article, the following terms shall have the meanings indicated:
LEAVES
Those material naturally formed on trees and bushes and shed annually.
MUNICIPAL SOLID WASTE
All residential, commercial, industrial and institutional solid waste generated within the boundaries of the Borough.
PERSONS
All residential, commercial and institutional property owners and/or occupants within the Borough.
It is hereby declared mandatory at all times that all persons, who accumulate leaves, separate same from municipal solid waste and dispose of these leaves by one of the methods described herein. Removal of leaves from commercial and residential properties through the normal garbage or refuse pickup is strictly prohibited.
A. 
During those periods of time when the municipal leaf composting facility is open, residents may deliver leaves to this facility in accordance with regulations established and enforced by the Mayor and Council of the Borough.
B. 
Leaves and other vegetative foliage may be retained for composting or mulch on the site from which they were generated, provided that such activities are not in violation of health and safety codes of the Borough or the state.
C. 
Leaves may be removed from any site within the Borough and disposed outside the Borough in any legal manner. Under no circumstances, however, shall leaves be disposed of at a solid waste facility in the State of New Jersey other than a leaf composting facility, vegetative waste composting facility or recycling center.
This article shall be enforced by the Police, Road Department, Zoning Enforcement Official, Construction Official or any other officers or employees of the Borough of Franklin Lakes designated by the above individuals or by the Mayor and Council.
