As used in this article, the following terms shall have the meanings indicated:
BOROUGH ROAD
Any street, road or thoroughfare within the Borough which has been dedicated to the Borough, the county or the state, whether or not the street or thoroughfare has been accepted including the full width and length of the public right-of-way.
A. 
It shall be unlawful for any person, within a Borough road with curbs, in the area from curb to curb, and within a Borough road without curbs, in the area from edge of pavement to edge of pavement:
(1) 
To cast, throw or spill any dirt, sand, ashes, gravel, brick, stones, wastepaper or other similar loose material.
(2) 
To mix any dry or wet concrete, cement or plaster of any kind or description.
(3) 
To spill any turpentine, kerosene, gasoline, petroleum, lubricating oil or other highly inflammable oils or their volatile products, or to allow any of such fluids to escape or to operate any tank trucks or other vehicle from which any such fluids are permitted to escape.
(4) 
To place or cause to be placed any permanent or temporary obstruction of whatever kind.
(5) 
To burn leaves or any other material.
(6) 
To fill or load any truck or motor vehicle with dirt, sand, gravel, earth, stones, rock, fill or other materials higher at any point than the lowest of the four sides of the body of the truck or motor vehicle, or to operate any truck or motor vehicle which has been so filled and loaded within the boundaries of the Borough, unless the entire portion of the truck or motor vehicle so filled or loaded shall have been covered by a tarpaulin securely fastened in such a manner as to prevent the contents of the truck or motor vehicle from being cast, spilled or thrown from the truck or motor vehicle.
B. 
It shall be unlawful for any person to place or cause to be placed any permanent or temporary obstruction of whatever kind on any Borough road, including the public right-of-way, which, in the discretion of the Police Department or the Code Enforcement Official, creates a public safety hazard.
C. 
The Borough shall not be responsible for any damage to anything that is placed or planted within a Borough road, including the public right-of-way. For example, if bushes are planted within the public right-of-way, the Borough shall not be responsible for any damages to such bushes.
D. 
The operator of any snowplow, or other snow removal equipment, clearing accumulated snow on private property shall not deposit, or cause to be deposited, such snow on any public road, street or highway, or on public property, or on private property other than the property on which the snow had accumulated.
A. 
The sight triangle is that area outside the right-of-way bounded by the intersecting street lines and a straight line which connects sight points located on each of the two intersecting street center lines: arterial streets at 300 feet, collector streets at 200 feet and local streets at 90 feet. Where the intersecting streets are both arterial and one collector, two overlapping sight triangles shall be required, formed by connecting the sight points noted above with a sight point 90 feet on the intersecting street.
B. 
Within a sight triangle, no grading, planting, structure or obstruction shall be erected or maintained more than 36 inches above the center-line grade of either intersecting street or driveway or lower than eight feet above their center lines, excluding street name signs and official traffic regulation signs. Where any street or driveway intersection involves earth banks or vegetation, including trees, the property owner shall trim and grade to provide the sight triangle.
A. 
Any person, firm, corporation, institution or agency, public or private, erecting a residential, business or industrial structure on lands abutting on a Borough road shall provide adequate drainage facilities, to be approved by the Borough Engineer, so as to prevent surface and other waters from flowing from the buildings and improvements on such lands to such Borough road.
B. 
Any person, firm, corporation, institution or agency, public or private, changing the contour of any land adjacent to a Borough road in such manner as to cause an increased or concentrated flow of surface water to run from such land to such Borough road shall provide adequate drainage facilities, approved by the Borough Engineer, so as to prevent such surface water from flowing upon such Borough road.
The Police Department and the Code Enforcement Official shall have power to compel the removal of any obstruction placed on any Borough road in violation hereof.
The Police Department and the Code Enforcement Official are each independently charged with the enforcement of all the provisions of these regulations.
This article is adopted for the purpose of keeping Borough roads in repair, safe and convenient for travel during all seasons of the year.
