[Adopted 2-14-1990 by Ord. No. 893 as Sec. 14-2 of the 1988 Code]
As used in this article, the following terms shall have the meanings indicated:
OWNER
The developer, applicant, agent, attorney, engineer or other person representing the legal owner, including any person having an agreement to purchase property in the Borough.

A. 
The Mayor and Council shall not accept and take over any street as a Borough road unless it complies with the specifications and requirements set forth in this section. No map submitted to the Mayor and Council for approval showing a street shall be approved unless compliance with the following specifications and requirements is clearly shown on the map. Where it is not possible to clearly show compliance with the following specifications and requirements on the map submitted to the Mayor and Council, the applicant or owner shall be required to furnish a guaranty of compliance by bond or such other surety as the Council shall approve. Where it is determined by the Mayor and Council that it is necessary to conduct core borings on any road to determine whether or not the road meets the Borough's specifications, the Mayor and Council may require that core borings be taken at the direction and under the control of the Borough Engineer. All expenses related to core borings shall be borne by the developer, including engineering fees.
B. 
The specifications and requirements for streets are the New Jersey State Highway Specifications for Road and Bridge Construction (1961 Edition, as amended), except those portions specifically not adopted or otherwise modified, amended or supplemented herein, hereby incorporated in this article as fully as if set forth at length. Three copies of the specifications hereinbefore referred to shall be placed on file in the office of the Borough Clerk and shall remain on file in the office as long as this article remains in effect for use and examination by the public.
(1) 
The width of right-of-way on newly laid out and constructed roads shall be at least 50 feet.
(2) 
The minimum graded width of the right-of-way referred to in the preceding Subsection B(1) shall be 50 feet. Slopes outside of the fifty-foot width shall be properly graded and stabilized in accordance with the requirements of the Borough Engineer.
(3) 
The minimum paved width of the right-of-way shall be 30 feet and shall be curbed with Belgian block curb unless concrete curb is approved by the Planning Board, and the curb shall be constructed as herein specified. The required width of pavement shall be measured from face to face of curbs, except at street intersections where the minimum curb radius shall be 35 feet. The top of the curb shall be set at an elevation of two inches higher than the center line of the pavement and shall have an exposed face of six inches.
(a) 
Specifications for construction of granite Belgian block curb. The curbs and headers shall be set with the top surface at the required grade for concrete curbs. Joints shall not be more than 1/4 inch wide for dressed and 3/8 inch wide for quarry split curbs and headers. The joints shall be pointed with one-to-one cement/sand mortar. Between granite curbs and adjacent concrete surfaces and base courses, which shall be Class C concrete, expansion joints shall be provided and filled with 1/4 inch preformed bituminous joint sealer. Curbing shall have a six-to-one batter with a six-inch curb face. All granite blocks shall be four inches to eight inches by six inches by 12 inches. Concrete joints shall be open joint every 10 feet. Overall height shall be a minimum of 18 inches from the bottom of the footing to the top of the curb. The roadway surface course shall cover the concrete footing. The finished curbs and headers shall be neat in appearance, installed in a workmanlike manner and shall not vary from the prescribed line and grade more than 1/4 inch at any point.
(b) 
Specifications for construction of concrete curb. With prior application to and written approval of the Planning Board, concrete curb shall be an acceptable alternate design to Belgian block curb. However, Belgian block curbs will be required by the Planning Board unless it is shown that they would be inappropriate, aesthetically or otherwise, or that the use of Belgian block curbing would create a substantial hardship for the applicant. The curb shall be six inches wide at the top, nine inches wide at the bottom and 20 inches in depth. Materials and workmanship shall be in accordance with the applicable specifications of the New Jersey State Highway Department Standard Specifications for Road and Bridge Construction, 1961 Edition, as amended. The concrete shall be Class B, 4,000 pounds per square inch.
(c) 
Specifications for pavement of roads. The roadway shall be paved from face to face or curb as follows:

The area to be paved shall be graded and compacted as specified in Section 203 of the New Jersey Department of Transportation Standard Specifications for Road and Bridge Construction, 1989 Edition as amended.
[2] 
The first course of pavement shall be a six-inch thick layer of dense graded aggregate base course. Material and workmanship shall comply with Sections 301 and 901 of the New Jersey Department of Transportation Standard Specifications for Road and Bridge Construction, 1989 Edition as amended.
[3] 
The second course shall be a four-inch thick layer of bituminous stabilized base course, Mix I-2. Material and workmanship shall comply with Sections 304 and 904 of the New Jersey Department of Transportation Standard Specifications for Road and Bridge Construction, 1989 Edition as amended.
[4] 
The third final course shall be a layer of bituminous concrete surface course, Mix I-5, 1 1/2 inches thick. Material and workmanship shall comply with Sections 404 and 904 of the New Jersey Department of Transportation Standard Specifications for Road and Bridge Construction, 1989 Edition as amended.
(4) 
The width of the sidewalk area shall be five feet in residential areas, eight feet in business or industrial areas and 10 feet in all other areas except in such places as material or structural barriers or trees make such width unadvisable, but in no instance shall a sidewalk with a width less than four feet be permitted. A sidewalk shall be graded at 1/4 of an inch to one foot toward the top of the concrete curb.
(5) 
A drainage system approved by the Borough Engineer sufficient to handle all drainage at all times and to prevent the collection of water in puddles on the right-of-way must be provided, and the location of catch basins, drainage outlets and other parts of this drainage system must be distinctly shown on the surveys or maps on file with the Borough. Materials and workmanship shall be in accordance with the applicable specifications of the New Jersey State Highway Department Standard Specifications for Road and Bridge Construction, 1961 Edition, as amended; provided, however, that all inlets and catch basin grates, either concave or flat, shall have oval-shaped reticular openings as shown in the Campbell Foundry Catalog, Pattern Nos. 2501, 2523, 3304, 3421, or equal; and further provided that the interior wall surfaces of all inlets, catch basins and manholes shall be treated with anti-hydro-coal tar epoxy coating, or equal, to be applied in accordance with the manufacturer's specifications and instructions.
(6) 
All outlets, and structures used by them in the right-of-way must be accurately and clearly designated on the map or survey.
(7) 
If any natural watercourse or stream crosses the right-of-way, proper provision for carrying it must be made and shown on the map or survey. If the stream is such as to come under the jurisdiction of the Board of Chosen Freeholders of the County of Bergen, its written consent to the location of the street must be provided, and the map or survey must show what type of structure, culvert or bridge will be provided for the watercourse or stream.
(8) 
At least five copies of a survey or map of the street shall be filed with the Borough Council when the application is made for the Borough to take over the road.
(9) 
The survey or map showing the location and setting of monuments, grading and contours must have the approval of the Borough Engineer or the Borough Council.
(10) 
The location and termini of the right-of-way must be such as to conform and not interfere with other streets of the Borough, and such as not to seriously interfere with the access to a through street or highway or any abutting property owner; and when any road is parallel, or nearly so, to the property line of an abutting property owner, it must run along the line or be at least 150 feet from the line at its nearest point.
(11) 
The title to the right-of-way must be approved by the Borough Attorney, and any deeds of dedication, releases of mortgages or other liens must be provided whenever required by the Borough Attorney.
In the case of used roadways serving houses at least one year old, the Mayor and Council may modify the specifications and requirements set forth in this article in order to avoid any hardship on individual property owners.
All applications for the approval of maps or plats must comply with the laws of the State of New Jersey relative to approval by the Bergen County Planning Board.
When maps are approved, the applicant must bind himself, in such manner as the Borough Council may require, to erect signs at all intersections conforming with the street signs erected by the Borough.
Notwithstanding compliance with all of the provisions of this article, the Mayor and Council shall have the right to refuse to approve or accept any street when, in its judgment, it is not advisable to grant such acceptance. The Mayor and Council may approve variations when, in its judgment, variations are advisable.
