The Township is hereby authorized to establish, operate and maintain permit parking spaces and nonpermit transient parking spaces in the Crescent Deck at Montclair Center and to establish the terms and conditions of all such parking spaces, the days and hours of operation, and the rates and fees to be charged for the use of all parking spaces in the Crescent Deck.

The Township is further authorized and directed to provide for the marking of the pavement adjacent to each parking meter for the purpose of designating the parking space regulated by each parking meter.
Every parking meter shall contain a legend indicating the number and types of coins which may be deposited in said meter, together with the respective periods of time which each of said coins, if there are more than one, shall entitle the vehicle to be parked in the parking space adjacent to said meter.

No vehicle shall be parked in any parking space between the hours of 8:00 a.m. and 6:00 p.m. of any day other than Sundays and legal holidays, or during such other time periods established by the Township, while or after the parking meter regulating such parking space shows a violation. Each vehicle shall be parked within the parking space marked upon the pavement adjacent to the meter regulating such space.

It shall be unlawful for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked in the Crescent Deck in violation of any “no parking” restrictions or other regulations established by the Township.

A. 
All permits for the Crescent Deck shall be in the form of a proximity card or such other form established by the Township.
B. 
Upon application therefor and upon the payment of a reasonable fee established by the Township, a replacement proximity card may be issued to any person; provided, however, that such replacement card shall cover only the balance of the period for which the original card was issued.

Every permit shall be affixed as a decalcomania to the motor vehicle for which issued upon the lower right corner of the rear window passenger side in such a manner as to be clearly visible from the exterior of the vehicle. Affixing such decal by the use of adhesive tape or any similar tape or device is prohibited except for multiple-car permits.

Subject to the provisions of § 230-30A, upon written application to the Township not later than five days prior to the first day of any month, which application shall be accompanied by the decal or due proof that the decal has been destroyed, and upon payment of a cancellation fee as provided in § 230-8, any person to whom a permit has been issued may obtain a refund of any permit fee paid by him or her which, in the case of an annual permit, shall be equivalent to 1/12 of the annual fee for each full month of the permit period remaining unexpired and, in the case of a semiannual permit, shall be equivalent to 1/6 of the semiannual fee for each full month of the permit period remaining unexpired. No refund shall be made for permits canceled during the last three months of their unexpired term.

Any person violating the provisions of this article shall, upon conviction thereof, be punished by a fine of not more than $50 or by imprisonment in the county jail for a period not to exceed 15 days, or by both such fine and imprisonment.[1]
