H & J Management located at l Carriage Way
has filed a written request with the Township of Montclair that the
provision of Subtitle One, Title 39, of the Revised Statutes of New
Jersey be made applicable to the private streets, semipublic roads,
streets, driveways and parking lots at One Carriage Way located in
the Township of Montclair, County of Essex. The Township of Montclair
has reviewed such request and determined that the same shall be approved
and now sets forth the following regulations which shall be enforceable.
A. Whenever any words and phrases are used in this section,
the meaning respectively ascribed to them in Title 39 of the Revised
Statutes of New Jersey shall be deemed to apply to such words and
phrases used herein.
B. All vehicles must park only in designated areas and
between the lines provided in accordance with the attached site plan.
C. The above-cited approved parking locations shall contain
parking spaces which are hereby designated as restricted parking for
use by persons who have been issued special vehicle identification
cards by the Division of Motor Vehicles. No other person shall be
permitted to park in the spaces authorized under this section. Said
location and designation shall be approved by the Director of Community
Services. Proper signage shall be provided by the applicant.

D. Any person parking a motor vehicle in a restricted
parking space without a special vehicle identification card shall
be liable to a fine of $100 for the first offense and, for subsequent
offenses, a fine of at least $100 and up to 90 days' community service
on such terms and in such form as the court shall deem appropriate,
or any combination thereof.
E. Stop intersections designated. In accordance with
the provisions of N.J.S.A. 39:4-140, the following intersections are
hereby designated as stop intersections:

F. Speed limits.
(1) The speed limits for both directions of traffic in
the parking lots shall be 15 miles per hour.

G. Tow away zone. Any vehicle parked or standing as to
obstruct or impede a normal flow of traffic; block entrances or exitways,
loading zones, oil fills, any grass area or pedestrian walkways; or
present in any way a safety or traffic hazard may be removed by towing
the vehicle at the owner's or operator's expense.
H. Parking prohibited at all times
(1) When signs are erected giving notice thereof, no person
shall stop, stand or park a vehicle, except when necessary to avoid
conflict with other traffic or in compliance with the law or the directions
or a police officer, or traffic-control device, at the following specific
designated locations:

(2) Fire lanes. In accordance with the State Fire Prevention
Code [N.J.A.C. 5:18-3.2(a), Article 3, Subsection F-311.0] which prohibits
parking in or obstructing designated fire lanes, and in accordance
with the attached site plan, when signs are erected giving notice
thereof, no person shall stop, stand or park a vehicle, except when
necessary to avoid conflict with other traffic or in compliance with
the law or the directions or a police officer, or traffic control
device, at the following specific designated locations:

I. Wherever such signs, posts, bolts or other necessary
materials are required to be installed, such signage shall be installed
and paid for by the applicant. Work shall be checked by the Police
Department to ensure installations meet state and federal specifications,
and all signing shall conform to the current Manual on Uniform Traffic
Control Devices.
J. Violations. Unless another penalty is expressly provided
by New Jersey Statute, every person convicted of a violation of this
section or any supplement thereto shall be liable to a penalty of
not more than $100 or imprisonment for a term not exceeding 15 days,
or both.
