Unless otherwise expressly stated, whenever used in this chapter, the
following words shall have the meanings given to them by this section.
DRIVER'S LICENSE
Permission granted by the Board of Trustees to any person to drive
upon the streets of said village any licensed taxicab.
OPERATOR
Any person owning or having control of the use of one or more taxicabs
used for hire upon the streets of the said Village of Albion, or engaged in
the business of operating a taxicab.
STREET
Any street, alley, avenue, land or public place in the Village of
Albion.
TAXICAB
Any motor vehicle engaged in the business of carrying persons for
hire, whether the same be operated from a taxi stand or subject to call from
a garage, residence or otherwise operated for hire, except vehicles subject
to the provisions of the Transportation Law or used by undertakers in the
conduct of their business.
TAXICAB DRIVER
Any person who drives a taxicab whether such person be the owner
of such taxicab or employed by a taxicab owner or operator.
TAXICAB LICENSE
Permission granted by the Board of Trustees to any person to operate
or keep for hire any taxicab in said village.
It shall be unlawful for any person to drive, operate or keep for hire
or pay within the limits of the Village of Albion any taxicab without first
having obtained and paid for a license to operate or keep such taxicab for
pay or hire, and having the same in force and effect, under the provisions
of this chapter.
No person shall drive a taxicab and no person shall permit anyone to
drive a taxicab within the limits of the Village of Albion without such driver
having first obtained and paid for and having in force and effect a driver's
license under the provisions of this chapter. Applications for taxicab driver's
licenses shall be made on forms supplied by the Board of Trustees and shall
be approved, in writing, by the Chief of Police. Such approval or disapproval
shall be subject to review and final decision by the Board of Trustees.

Drivers' licenses shall be issued to expire on April 1 following
the date of issue. The fee of such license shall be as set forth from time
to time by resolution of the Board of Trustees.
It shall be unlawful for any person to operate or permit to be operated
a taxicab upon the streets of the Village of Albion without having first obtained,
paid for and having in force and effect a taxicab license under the provisions
of this chapter.

Taxicab licenses shall be issued to expire on April 1 following the
date of issue. The fee for such license and for each additional taxicab owned
or operated by the same applicant shall be as set forth from time to time
by resolution of the Board of Trustees. No license shall be issued for a taxicab unless the application
is accompanied by a certificate of a duly qualified mechanic that the said
taxicab is equipped according to the laws of the State of New York, is in
good mechanical repair and is in safe operating condition; and a new certificate
as above required shall thereafter be furnished as to any taxicab to which
a license has been issued whenever the Chief of Police or the Board of Trustees
shall require it. The Chief of Police shall have the right and at any time
when in his or her judgment it is advisable to make his or her own inspection
of any such taxicab or direct such an inspection by his or her own designee.
A license shall be refused to, or, if already issued, shall be revoked or
suspended of any vehicle found to be unfit or unsuited for patronage.
All licenses under this chapter shall be authorized by resolutions of
the Board of Trustees and shall be issued over the signatures of the President
(Mayor) and Clerk of the village and only upon payment of the fees therefor.
Every driver of a taxicab shall have the right to demand payment of
the legal fare in advance and may refuse employment unless so prepaid, but
no driver of a taxicab shall otherwise refuse or neglect to convey any orderly
person or persons upon a request anywhere in the village, unless previously
engaged or unable to do so.
No license obtained pursuant to the provisions of this chapter may be
transferred but shall be and remain for the proper use and benefit of the
parties obtaining same; provided, however, that a taxicab license may be transferred
from one vehicle to another by the same owner upon proof being submitted to
the Village Clerk and satisfactory to him or her that the vehicle from which
said license is transferred is no longer owned or used as a taxicab in the
Village of Albion, but only upon an endorsement of such transfer upon said
taxicab license.
No license pursuant to the provisions of this chapter shall allow or
permit any person to ride in a taxicab with a person or persons who have previously
engaged such taxicab without the consent of such person or persons.
Any licensee under this chapter shall, within three days after a change
in his or her residence address, notify the Village Clerk of his or her new
address.
Any license issued pursuant to this chapter may be revoked for cause
at any time, and sufficient cause shall include any violation of this chapter
and a conviction for violation of any other law of the Village of Albion or
law of the State of New York, except the parking-meter laws of said village.

A suitable rate card shall be conspicuously posted in the interior of
every taxicab. Every licensed taxicab shall be provided with a printed receipt
pad, and said licensed driver shall, whenever requested by a passenger, give
him or her a receipt for the fare.

No taxicab shall stand or park on the streets in the Village of Albion,
New York, when not in use, between the hours of 9:00 a.m. and 6:30 p.m., except
on such streets or portions of streets as shall be designated as taxicab stands
by the Board of Trustees and no taxicab, when in use, shall stand or park
upon the streets in said village in excess of 15 minutes at any time, except
on such streets or portions of streets designated as taxicab stands. Operators
who do not wish to use the streets or portions of streets designated by the
Board of Trustees as taxicab stands must provide a private stand approved
by the Board of Trustees, and such taxicabs must be kept on such stands at
all times when not in use.

Any person who shall violate any provision of this chapter shall, upon
conviction, be punishable by a fine not exceeding $250 or by imprisonment
not to exceed 15 days, or both such fine and imprisonment.
