Any person who is a physically handicapped person, as defined in §
235-36 hereof, may apply to the Coordinator of the Nassau County Council to Aid the Handicapped, who shall hereinafter be designated as "Coordinator," for a special parking permit. Said Coordinator shall arrange for a medical examination of the applicant at the Nassau County Medical Center upon the receipt of said application. Upon completion of said physical examination, the Nassau County Medical Center, if it determines that the applicant qualifies as a physically handicapped person, shall certify said fact to the Coordinator. The following shall be certified by the Nassau County Medical Center:
A. The nature and duration of the disability.
B. The cause of the disability.
C. The date of the last examination.
D. Whether the disability is progressive.
The form of the application by a person claiming
to be a physically handicapped person shall be drawn by the Coordinator
and shall include the following information:
A. The name and address of the applicant.
B. The age, date of birth, sex, height, weight, color
of hair and color of eyes of the applicant and whether married or
single.
C. The type of driver's license held by the applicant
and the license or identification number thereof and the date of issuance
and expiration date thereof.
D. All the restrictions listed said driver's license.
E. The occupation and social security number of the applicant.
F. The name and address of the applicant's employer and
business phone.
G. If the applicant is a student, the name and address
of the school, course of study and hours of attendance.
H. The name and address of the owner of the vehicle to
be used.
I. The year, make, type, identification or serial number
and color of said vehicle, the license plate number and the tab number,
if any, and the year for which issued and state which issued the same.
When used in this article, "physically handicapped
person" shall mean any person who, by reason of a defect or infirmity,
whether congenital or acquired by accident, injury or disease, is
permanently incapacitated, totally or partially, from walking without
assistance of artificial devices.
Any permit issued pursuant to this article,
to be effective, shall be conspicuously displayed against or near
the inside lower right front window of the motor vehicle in which
the physically handicapped person in whose name the permit is issued
shall be transported at the time.
Upon certification by the Nassau County Medical Center that an applicant is a physically handicapped person, the Coordinator shall issue a special parking permit to the applicant, which shall be affixed to this automobile as provided in §
235-37 of this article. The Coordinator shall also issue to the applicant an identification card having the same number as that on the sticker affixed to the automobile.
Physically disabled drivers' parking permits
shall be in the form prescribed by the Coordinator and shall expire
on the first day of March next following their issuance. Such permits
shall not be transferable and shall be subject to such conditions,
rules and regulations as the Board of Trustees of the Incorporated
Village of Atlantic Beach may establish by resolution; and the acceptance
of a permit shall constitute an agreement to comply with such conditions,
rules and regulations. Such permits shall be placed within the motor
vehicle so as to be visible and legible from the outside thereof when
the vehicle is parked, stopped or left standing in a parking space
set aside under this article.
The sticker issued by Nassau County shall contain
a code which shall indicate the town, city or incorporated Village
in which the driver resides.
It is the intent of this article that any person
certified to be a physically handicapped person, as hereinbefore provided,
shall be exempt from the provisions of any and all ordinances, regulations,
orders or other laws of the Incorporated Village of Atlantic Beach
with respect to the parking of motor vehicles, and specifically including
parking meters in said incorporated Village.
No fee shall be charged in applying for the
certification by Nassau County as a physically handicapped person.
Should a person other than the person to whom
the permit is issued be found to be using the motor vehicle in question
and having claimed the privileges granted under this article, said
permit issued to the physically handicapped person shall be suspended
for six months for the first offense. After a second offense, the
permit shall be revoked. Prior to suspension or revocation as herein
provided, a hearing shall be held by the Coordinator. Notice of any
hearing to be held by the Coordinator for revocation or suspension
of any license or permit shall be mailed, by ordinary mail, to the
holder of the permit directed to the address of such holder as set
forth in the application. Such notice shall be mailed not less than
five days prior to the hearing date and shall advise said holder of
the permit of the time and place of the hearing and shall contain
a concise statement of the reason or reasons for holding the hearing.
Rules of law with respect to the admissibility of evidence in the
conduct of such a record of the findings as he deems to be justified
by all the evidence presented at such hearing, and his findings shall
be conclusive as to all matters of fact.
The parking spaces designated in Schedule XXIII (§
235-68), being properly identified as "handicapped parking spaces" are reserved for vehicles bearing the window sticker issued by the Coordinator. It shall be unlawful for any other vehicle to occupy any of the spaces so designated.
