A.
The owner
of each property within the Village of Hempstead, where wastes are
removed by the Village, shall be charged for such removal in accordance
with a schedule of fees, as may be determined from time to time by
resolution of the Board of Trustees.[1]

B.
However,
if a multiple dwelling, commercial facility or premises that has the
option of using private sanitation chooses to do so, it must notify
the Village Clerk, in writing, with copies to the Superintendent/Director
of Public Works and the Superintendent of Tax and Water, of such intention
to discontinue Village sanitation removal.

This
notification must be sent no sooner than the first of January and
no later than February 1 for the ensuing tax year, which commences
the first of June and will be effective on June 1 of the year in which
timely notice is given.

Notices
sent after February 1 will not be deemed effective for the termination
of services for the ensuing tax year, and the premises will be assessed
a sanitation fee, even if private sanitation is used.
Bills for sanitation user fees shall be sent
to each owner of property where wastes are removed by the Village
and shall be included as a separate line item on regular Village real
property tax bills and shall be due and payable at the same time as
Village real estate taxes.
A.
Overdue and unpaid sanitation user fees shall become
liens against the property to which they relate and shall be collectable
in the same manner as real estate taxes.
B.
Interest, penalties and fees shall be added to any
unpaid sanitation user fees as may be provided by law for the collection
of past-due real estate taxes.
The Village reserves the right in its own discretion
to refuse to provide sanitation waste removal services in regard to
any property within the Village.
