Editor's Note: Junk dealer regulations were adopted as Art. IV of L.L. No. 4-1981, which law relates as well to Ch. 48, Boardinghouses and Rooming Houses; Ch. 68, Food-Handling Establishments; Ch. 71, Garage Sales; Ch. 86, Licensing and Business Regulations; Ch. 92, Parking Field Businesses; Ch. 97, Peddlers and Solicitors; Ch. 109, Secondhand Dealers; and Ch. 124, Theaters.
No person shall engage in or conduct business as a dealer or collector
of junk, or in the business commonly known as the "junk business," or in the
collection, purchase, storage, sale or disposal of junk, without first having
obtained a license therefor as provided in this chapter. "Junk" shall include
but not be limited to old rope, old iron, brass, copper, tin, lead, rubber,
paper, rags, bagging, bottles and similar items.
Any vehicle used upon the streets of the Village for the purpose of
engaging in the junk business shall be deemed a junk cart. A description of
any such vehicle shall be filed with the Village Clerk prior to its use as
a junk cart in the Village.
Any vehicle used for the purpose of collecting or selling any article or articles enumerated in § 82-1 shall be equipped with a plate, provided by the Village Clerk, to be affixed by the licensee to a conspicuous and indispensable part of the vehicle, on which plate shall be clearly set forth the official number of the junk cart with the words "junk cart" and the date of expiration of the license.
No junk cart shall employ the use of any bell, horn or other sound-making
device upon the streets of the Village when attempting to attract attention
to its business purposes.
Each licensee under this chapter shall comply with the following requirements:
A.
No licensee shall collect or purchase any junk, metal
or secondhand materials or articles of any kind from any person who is actually
or apparently under the age of 21 years.
B.
Each licensee shall keep a book record of each article
of junk, metal or secondhand material purchased or collected by him, showing
the time and place of collection or purchase and the name and address of the
person from whom the articles were collected or purchased; and the licensee
shall not dispose of any such article purchased or collected until the expiration
of 15 days from the date of the purchase or collection.
C.
A licensee shall not collect or purchase junk, metals
or secondhand materials from any person between the hours of 7:00 p.m. and
7:00 a.m.
D.
Each licensee shall permit his place of business, his
record books and his vehicles of conveyance to be examined or inspected at
any time by the police or by any representative of the Village Board.
