GENERAL REFERENCES

Unless otherwise stated expressly, the following words and expressions shall have the following meanings ascribed to them by this chapter:
CERTIFIED or CERTIFY
A signed statement or report stating the signer to the best of his or her knowledge believes the estimates contained therein are true and accurate.
DISCRETIONARY EXPENSES OR APPROPRIATIONS
Any expenses or appropriation of any fund under the control of the Town Board or department head of the town appointed by the Town Board, the reduction or abolition of which will not violate any state law or breach any contract authorized by the Town Board.
A. 
The Town Supervisor shall submit to the Town Board and file a copy with the Town Clerk, in addition to any other requirements mandated by state law, the following with his annual budget:
(1) 
A statement of each anticipated line item balance (including but not limited to the general fund, the Part Town Fund and the funds of each special district of the town) with an explanation for any anticipated variance which deviates more than ten percent (10%) from the current budget (either as surplus or a deficiency), referencing specific revenue shortfalls or increases, increased or decreased expenses and the reasons therefor.
(2) 
Where the anticipated fund balance (surplus or deficit) of any fund is greater than five percent (5%) of the funds budget, the Supervisor shall file a report to the Town Board explaining the reasons.
B. 
Within ten (10) days of the filing of the Supervisor's budget, the Director of Audit and Control of the town shall certify to the Town Board the correctness of the Supervisor's estimated revenues, anticipated fund balances and appropriations. In the event that the Director of Audit and Control of the town disagrees with any of the figures contained in the Supervisor's budget, he/she shall state the reasons therefor and shall recommend to the Town Board his/her estimate other than as provided in such budget.
A. 
The Director of Audit and Control shall certify and report to the Town Board and file with the Town Clerk within thirty (30) days after the close of the first and second quarter the following:
(1) 
A trial balance of each fund.
(2) 
An estimate of the anticipated year-end fund balances for each fund.
(3) 
A comparison of the estimated annualized receipts and estimated expenses to the current budget.
(4) 
Interfund borrowing report.
(5) 
An analysis of material variations [as defined as those greater than five percent (5%) or two thousand five hundred dollars ($2,500.)].
B. 
The annual budget document shall include detailed revenue and expense estimates for the current year in order to forecast as accurately as possible the fund balance for each fund and to provide a basis on which to commence the ensuing year's budget.
The Town Board shall be provided with the estimated debt service such bond would require during its life (a debt service schedule) and an estimate of total debt service requirements for the next three (3) years. Included shall be the percentage of the fund's budget committed to debt service and the percentage of change the contemplated action would create. These schedules shall be provided to the Town Board, not earlier than ten (10) days or later than three (3) days before such vote.
Within fifteen (15) days of filing the report required by § 10-3, the Supervisor shall present to the Town Board a plan of corrective action making such amendments to the town budget as necessary to prevent a deficit from occurring in any fund. The Town Board shall adopt or reject the plan or adopt a plan of its own. In the event that the Town Board fails to act within ten (10) days of the submission of the Supervisor's plan, the Director of Audit and Control shall reduce the budgets in a proportionate manner sufficient to prevent a deficit, provided that such reduction or abolishment will not violate state law or breach any contract authorized by the Town Board. Within ten (10) days of Town Board action or the expiration of fifteen (15) days for Town Board action as required under this section, the Director of Audit and Control shall direct department heads to prioritize cuts in discretionary spending including but not limited to funds budgeted for exempt positions, conference and dues, overtime, outside professionals, temporary and seasonal salaries and other reductions as may be necessary.
Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor contained in §§ 29, 52 and 125 of the Town Law of the State of New York or any statutory or other powers which may be lawfully exercised by said Supervisor.
