No person shall:
(A) Bring or possess beverages having any alcoholic content, nor shall any person drink alcoholic beverages at any time in the parks or on the beaches, except:
(1) At certain specifically designated recreation centers where meals or lunches are served under concession privileges, the sale of alcoholic beverages by such concessionaire is permitted under the strict regulation and control of the Director. Sales of alcoholic beverages shall be made only in individual drinks (not in original packages or otherwise in bulk) and shall be served for consumption on the property operated by concession; and
(2) Beer, liquor and wine may be served in designated areas pursuant to a properly issued New York State Liquor Authority permit and prior approval by the Town Board Resolution as provided in §
159-31(L).
(B) Be under the influence of drugs or alcohol.
(C) Bring or have in his possession, or set off or otherwise cause to explode or discharge or burn, firecrackers, fireworks or explosives of flammable material, or discharge them or throw them into a park from any land or highway adjacent thereto. This includes any substance, compound, mixture or article that in conjunction with any other substance or compound would be dangerous from any of the foregoing standpoints.
(D)(1) The Town Board has approved on-leash walking of dogs in town parks and trails. All dogs in those areas where such animals are permitted shall be restrained at all times on adequate leashes not greater than six (6) feet in length and shall not run at large. Dog waste must be immediately collected and removed by the owner or person in charge of the dog.
| (2) | It shall be unlawful for any person to allow a dog leashed and/or unleashed to be in any of the following town properties or parts thereof, unless the dog is a service dog: |
| | (a) | Heckscher Park's Harry Chapin Rainbow Stage area during performances or events; |
| | (b) | Betty Allen Nature Preserve; |
| | (c) | All playgrounds; |
| | (d) | All picnic areas; |
| | (e) | All park benches; |
| | (f) | All active recreation areas including but not limited to courts and sports fields; |
| | (g) | All town camp or town-licensed education program areas; |
| | (h) | All town beaches except for paved areas and boardwalks. |
(E) Appear at any public place in other than proper clothing.
(F) Solicit contributions for any purpose, whether public or private, except where authorized by the Director.
(G) Build a bonfire, fire or barbeque at any public park or beach other than in designated picnic areas or pursuant to a permit issued by the Director. No person shall bring a barbeque grill or similar device into a park or beach without prior approval of the Director.
(H) Gamble or participate in or abet any game of chance.
(I) Behave in a loud, boisterous, threatening, abusive, or threatening manner, or engage in disorderly conduct or behavior tending to breach the public peace and good order, or cause discomfort or inconvenience to any person or patron.
(J) Fail or refuse to produce and exhibit any permit upon request of park personnel or an enforcement officer.
(K) Disturb or interfere unreasonably with any person or party occupying any area or participating in an activity under the authority of a permit.
(L) Erect any structure, stand, platform, tent or apparatus, or hold any meetings, perform any ceremony, exhibit any performance, or form any parade or procession in any park without first obtaining a permit.
(M) Use town parks for any purpose other than recreation.
(N) Smoke or vape a tobacco product; herbal product; cigarette; electronic cigarette; pipe or cigar; vapors; or e-liquids in an outdoor playground, athletic field or beach. This prohibition applies only to public playgrounds and beaches and is not intended to include private property to which the general public does not generally have access or private areas used exclusively for private functions. "No Smoking" signs, or the international "No Smoking" symbol, which consists of a pictorial representation of a burning cigarette enclosed in a circle with a bar across it, shall be prominently posted where smoking is regulated by this subsection. In the event a playground is not enclosed by fencing or other partition, no smoking shall be permitted beyond the signs posted in accordance with this section. This prohibition is not intended to include parking lots at beaches.
(O) Consume cannabis in a park or beach, including but not limited to parking lots.
(P) Use a skateboard, scooter or other similar device for any reason except in designated areas.
