No person in a park shall:
(A) 
Willfully mark, deface, disfigure, injure, tamper with, displace or remove any building, bridge, fence, table, bench, fireplace, railing, paving or parking material, waterlines, utilities, signs, notices or placards, monuments, stakes, posts or other boundary markers, structures, equipment, facilities, or other public improvements and appurtenances thereto.
(B) 
Fail to cooperate in maintaining washrooms and rest rooms in a neat and sanitary condition. No person over the age of six (6) years shall use the rest rooms and washrooms designated for the opposite sex, unless physically disabled and requiring special accommodation.
(C) 
Dig and remove any beach sand, whether submerged or not, or any soil, rock, stones, trees, shrubs or plants, downed timber or other wood or material or make any excavation by tool, equipment, blasting or other means or agency.
(D) 
Construct or erect any building or structure of any kind, whether permanent or temporary in character, or run or string any public utility into, upon or across such lands, except by Resolution of the Town Board or as provided in § 159-31(K).
(E) 
Build a bonfire, fire, or barbeque at any public park or beach other than in designated picnic areas or pursuant to a permit issued by the Director. No person shall bring a barbeque grill or similar device into a park or beach without prior approval of the Director.
(F) 
Walk, stand, sit on, or utilize monuments, vases, fountains, railing, fences, gun carriages or upon any other property not designated or customarily used for such purposes.
(G) 
Erect, maintain, use or occupy on or in any park, beach or building any tent, shelter or structure of any kind, except that tents or shelters of the type where there is an unobstructed view into said tent, shelter or structure from at least two (2) sides will be permitted outdoors. In no event shall any guy wire, rope, extension or exterior brace or support be connected or fastened from any such structure to any other structure, tree, rock or object.
No person in a park shall:
(A) 
Damage, cut, carve, transplant or remove any tree plant, or vegetation, or injure the bark or pick the flowers or seeds of any tree or plant. Nor shall any person attach any rope, wire or other contrivance to any tree or plant. A person shall not dig in or otherwise disturb natural or maintained landscape areas or in any other way injure or impair the natural beauty, appearance, or usefulness of any area.
(B) 
Climb any tree or plant.
(C) 
Tie or hitch a horse or other animal to any tree or plant.
No person in a park shall:
(A) 
Hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw an object at any animal or mammal; or remove or have in his or her possession the young of any wild animal, or the eggs or nest of any mammal.
(B) 
Give or offer or attempt to give to any animal or bird any food, tobacco, alcohol, or other known noxious substances.
No person shall be admitted to any park who is under the age of six (6) years unless accompanied by an adult who shall assume full responsibility for the minor's safety and conduct.
No person in a park shall:
A. 
Throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pond, lake in or adjacent to any park, or any tributary, stream, storm sewer or drain flowing into such waters, any substance, matter or thing, liquid or solid.
B. 
Bring in or dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, yard or construction debris, garbage, trash, or other material. No such refuse or trash shall be placed in any waters or left anywhere on park grounds, but shall be placed in the proper receptacles where these are provided; where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere.
No person in a park shall:
A. 
Fail to comply with all applicable provisions of the New York State Motor Vehicle and Traffic Law, the rules and regulations of the Suffolk County Police Department, and laws and regulations of the Town of Huntington regarding equipment and the operation of vehicles.
B. 
Fail to obey the lawful order or direction of a police officer, harbormaster, and town official, including traffic officers and town employees, authorized to direct traffic as needed in the parks, and on the adjacent highways, streets and roads.
C. 
Fail to observe all traffic signs indicating speed, direction, caution, yield, stopping or parking, and all signs and devices posted to maintain proper traffic control and safeguard life and property.
D. 
Ride or drive a vehicle at a rate of speed exceeding ten (10) miles per hour, except as may be otherwise designated by the Director.
E. 
Drive any vehicle on any area except paved park roads which are open to the public, parking areas or other areas specifically designated by the Director.
F. 
Use or operate an all-terrain vehicle, dirt bike, mini-bike, or other similar motorized vehicle designed or equipped to operate outside of paved surfaces of roadways.
G. 
Park a vehicle in other than an established or designated parking area, and such use shall be in accordance with the posted instructions or the instructions of any authorized person or official on site.
H. 
Fail to use a muffler adequate to deaden the sound of the engine in a vehicle.
I. 
Repair, wash, wax or perform other maintenance on a vehicle.
No person shall:
A. 
Ride a bicycle on other than a road or path designated for that purpose. A bicyclist shall be permitted to wheel or push a bicycle by hand over any grassy area or wooded trail or on any paved area reserved for pedestrian use.
B. 
Ride a bicycle other than on the right-hand side of the road paving as close as conditions permit, and bicycles shall be kept in single file when two (2) or more are operating as a group. Bicyclists shall at all times operate their machines with reasonable regard to the safety of others, signal all turns, and follow all New York State laws and regulations for bicycle operation.
C. 
Ride any other person on a bicycle.
D. 
Leave a bicycle in a place other than a bicycle rack where provided and there is a space available.
E. 
Leave a bicycle lying on the ground or paving or set against trees or in any place or position where other persons may trip over or be injured by it.
F. 
Ride a bicycle on any road between thirty (30) minutes after sunset and thirty (30) minutes before sunrise without an attached headlight plainly visible at least two hundred (200) feet in front of such bicycle and without a red taillight or red reflector plainly visible from at least one hundred (100) feet from the rear of such bicycle.
G. 
Ride a horse except on designated bridle trails. Where permitted, horses shall be thoroughly broken and properly restrained and ridden with due care. Horses shall not be allowed to graze or go unattended, nor shall they be hitched to any rock, tree, shrub or structure.
No person shall:
(A) 
Swim, bathe or wade in any waters or waterways in or adjacent to any park, except in designated areas. Nor shall any person swim, wade or congregate in any area where swimming is permitted if, in the opinion of the Director or other government official or agency, the quality of the water is not safe or other conditions exist which would jeopardize the health or safety of the public. Such designated bathing areas shall be kept free from water equipment, floating devices or other apparatus which, in the Director’s judgment, may cause inconvenience, harm, injury or discomfort to bathers.
(B) 
Swim or wade except during the hours designated by the Director for such purpose.
(C) 
Erect, maintain, use or occupy on or in any beach or bathing area any tent, shelter or structure of any kind unless there shall be an unobstructed view into said tent, shelter or structure from at least two (2) sides; nor shall any guy wire, rope, extension or exterior brace or support be connected or fastened from any such structure to any other structure, tree, rock or object.
(D) 
Erect, install or maintain on any beach or park, a beach umbrella or similar device unless such umbrella or device is securely fastened to prevent movement due to wind or other sources.
(E) 
Appear in bathing attire at any place in the parks or beaches except within the limits of designated bathing areas, and all bathing wear shall conform to commonly accepted standards.
(F) 
Dress or undress on any beach or in any vehicle, toilet room or other place, except in such facilities as may be provided for that purpose.
(A) 
Dix Hills Pool: All persons seeking admittance to the pool are required to present a family or individual seasonal pass, or a daily pass to the attendant in charge.
(1) 
Application for a family or individual seasonal pass, or a daily pass shall be made at the facility. Proof of residency shall be required. A fee in an amount established by the Town Board shall be payable at the time of application.
(2) 
A seasonal pass shall entitle the holder to use the facility for one (1) season only.
(3) 
Daily passes may be issued for any day of the week to residents upon the payment of a fee.
(4) 
Guest(s) of residents may be admitted upon the payment of a fee and shall be accompanied by a resident holding a seasonal or daily pass.
(B) 
Ice Rink: All persons who wish to skate shall pay a fee in an amount established by the Town Board. Any person who has paid for and is enrolled in town-sponsored skating lessons shall not be charged an admission fee to use the facilities. Persons taking private skating lessons shall pay an admission fee at the door.
(C) 
All persons using town facilities at Dix Hills Park shall obey the rules and regulations of the Director and of the attendants in charge. Any person who interferes with or violates the order or directive of the Director, rink guard, lifeguard or other town personnel shall be in violation of this chapter, and in addition to any penalty provided for herein, may be removed from the facility as is deemed necessary to preserve the peace and good order, or protect the safety and welfare of other patrons.

(A) 
Beach parking sticker. Every resident of the Town of Huntington shall be eligible to receive a resident beach parking sticker for the season by submission of proof of residency and payment of the requisite fee established by the Town Board, except that senior citizens who have attained the age of sixty (60), active-duty military and military veterans who were honorably discharged or released under honorable circumstances from active duty in the armed forces of the United States shall, upon submission of proof of residency and of their status as a senior citizen or documentation showing active duty or their status as honorably discharged or released under honorable circumstances from active duty, receive a free beach parking sticker. Residents and non-residents may be issued a daily pass for a fee in an amount established by the Town Board.[1]

(A) 
A resident of the Town of Huntington may, during the beach season each year, store a dinghy or kayak not exceeding fourteen (14) feet in length on the dinghy rack upon payment of a permit fee for which a decal will be issued. The Town of Huntington assumes no responsibility or liability for loss, property damage, theft or vandalism of any kayak or dinghy stored on such racks, and the owner assumes full responsibility for any loss.
(B) 
It shall be unlawful for a person to place any dinghy, kayak or other vessel on a dinghy rack without first having obtained a permit; or, having secured a permit, place a dinghy, kayak or other vessel on the rack without having affixed the permit decal to the vessel. Such vessel shall be impounded by the Department of Maritime Services, in accordance with the procedures established for abandoned and unseaworthy vessels in Chapter 120. In all cases an impound fee and the actual cost of providing notice to the owner, removal charges, storage fees, and other expenses incurred by the Town pursuant to Chapter 120 shall be paid by the owner or person-in-charge of the vessel before the vessel is released, and if the owner is not found, the expenses shall be paid out of the proceeds of the public auction.

The following shall apply to boat launching activities at the Town of Huntington Mill Dam Ramps, except where expressly stated otherwise:
(A) 
Commercial boat launching businesses whose principal place of business is situated in the Town of Huntington shall be issued an annual permit to use the Mill Dam Ramps upon payment of a fee in an amount set by the Town Board, and paid at the office of the Huntington Harbor Master.
(B) 
Only a resident who has been issued a beach parking permit may purchase a seasonal launch permit to launch and remove a boat owned by the permit holder at the Town's launching ramps. A resident who owns multiple boats will need to purchase a launching sticker for each vessel. All vehicles and vessels owned by residents purchasing beach parking permits and ramp stickers must be registered to a location within the Town of Huntington.
(C) 
Residents and non-residents who do not have a beach parking sticker or launching sticker may be issued a daily pass for either privilege upon payment of a fee in an amount established by the Town Board.
No person shall:
(A) 
Bring into or operate any boat, raft or other watercraft, whether or not motor-powered, upon any waters at places designated for swimming or bathing.
(B) 
Fish offshore from Town-operated parks or beaches except in designated areas, and no person shall fish in any area at any time while swimming is permitted.

(A) 
No person shall hunt, trap or pursue wildlife at any time. No person shall use, carry or possess firearms of any description or air rifles, spring guns, paintball weapons, bow and arrows, slings or any other form of weapon potentially harmful to wildlife and dangerous to human safety, or any instrument that can be loaded with and fire blank cartridges, or any kind of trapping device. Shooting into park areas from beyond park boundaries is forbidden. This provision does not apply to a law enforcement officer acting in the course of his or her official duties, authorized personnel approved by the Director, or as set forth in § 109-3(F). The prohibitions described in § 159-4 shall remain in full force and effect.
(A) 
Reservation of picnic areas.
(1) 
Designated picnic areas are open to the general public; however, picnic areas will only be reserved for a particular event or function if a permit has been issued by the Director.
(2) 
Applications to reserve designated picnic areas shall be filed with the Department of Parks and Recreation no later than fifteen (15) business days before the scheduled event. No application shall be complete and no permit will be issued unless accompanied by the requisite application fee and all documents required by the Director.

(B) 
General regulations. No person shall:
(1) 
Picnic in a place other than in designated picnic areas. The Director may regulate activities in such areas when necessary to prevent congestion, maintain safety or secure the maximum use for the comfort and convenience of all. Any person who interferes with or violates a regulation or order of the Director, or his designee, shall be in violation of this Chapter.
(2) 
Acquire use of the individual grills or fireplaces, with tables and benches in violation of the "first come, first served" rule, except if a permit to reserve the area has been issued by the Director.
(3) 
Use any portion of designated picnic areas for a picnic to the exclusion of other persons, nor shall any person use such area and facilities for an unreasonable length of time if the facilities are crowded.
(4) 
Ignite or maintain a fire on any beach or park except in grills or fireplaces located in designated areas.
(5) 
Leave a picnic area before a fire is completely extinguished and before all trash in the nature of boxes, papers, cans, bottles, and other garbage is placed in trash receptacles where provided. If a receptacle is not available, then the trash shall be carried away from the park by the picnicker to be properly disposed of elsewhere.
(A) 
No person shall take part in or abet the playing of any games involving thrown or otherwise propelled objects, such as paintballs, stones, arrows, javelins or model airplanes, except in areas set apart for such forms of recreation.
(B) 
Organized or league sports and games such as football and baseball, and golf, are prohibited except on fields, courts and areas designed for such purpose.
(C) 
Skateboarding, inline skating, horseback riding, trail bicycle riding, BMX bicycling and aerial stunts using boards, bicycles, skates or other apparatus shall be permitted only where specifically designated and posted by the Director.

No person shall:
(A) 
Bring or possess beverages having any alcoholic content, nor shall any person drink alcoholic beverages at any time in the parks or on the beaches, except:
(1) 
At certain specifically designated recreation centers where meals or lunches are served under concession privileges, the sale of alcoholic beverages by such concessionaire is permitted under the strict regulation and control of the Director. Sales of alcoholic beverages shall be made only in individual drinks (not in original packages or otherwise in bulk) and shall be served for consumption on the property operated by concession; and
(2) 
Beer, liquor and wine may be served in designated areas pursuant to a properly issued New York State Liquor Authority permit and prior approval by the Town Board Resolution as provided in § 159-31(L).
(B) 
Be under the influence of drugs or alcohol.
(C) 
Bring or have in his possession, or set off or otherwise cause to explode or discharge or burn, firecrackers, fireworks or explosives of flammable material, or discharge them or throw them into a park from any land or highway adjacent thereto. This includes any substance, compound, mixture or article that in conjunction with any other substance or compound would be dangerous from any of the foregoing standpoints.
(D)(1) 
The Town Board has approved on-leash walking of dogs in town parks and trails. All dogs in those areas where such animals are permitted shall be restrained at all times on adequate leashes not greater than six (6) feet in length and shall not run at large. Dog waste must be immediately collected and removed by the owner or person in charge of the dog.
(2)
It shall be unlawful for any person to allow a dog leashed and/or unleashed to be in any of the following town properties or parts thereof, unless the dog is a service dog:
(a)
Heckscher Park's Harry Chapin Rainbow Stage area during performances or events;
(b)
Betty Allen Nature Preserve;
(c)
All playgrounds;
(d)
All picnic areas;
(e)
All park benches;
(f)
All active recreation areas including but not limited to courts and sports fields;
(g)
All town camp or town-licensed education program areas;
(h)
All town beaches except for paved areas and boardwalks.
(E) 
Appear at any public place in other than proper clothing.
(F) 
Solicit contributions for any purpose, whether public or private, except where authorized by the Director.
(G) 
Build a bonfire, fire or barbeque at any public park or beach other than in designated picnic areas or pursuant to a permit issued by the Director. No person shall bring a barbeque grill or similar device into a park or beach without prior approval of the Director.
(H) 
Gamble or participate in or abet any game of chance.
(I) 
Behave in a loud, boisterous, threatening, abusive, or threatening manner, or engage in disorderly conduct or behavior tending to breach the public peace and good order, or cause discomfort or inconvenience to any person or patron.
(J) 
Fail or refuse to produce and exhibit any permit upon request of park personnel or an enforcement officer.
(K) 
Disturb or interfere unreasonably with any person or party occupying any area or participating in an activity under the authority of a permit.
(L) 
Erect any structure, stand, platform, tent or apparatus, or hold any meetings, perform any ceremony, exhibit any performance, or form any parade or procession in any park without first obtaining a permit.
(M) 
Use town parks for any purpose other than recreation.
(N) 
Smoke or vape a tobacco product; herbal product; cigarette; electronic cigarette; pipe or cigar; vapors; or e-liquids in an outdoor playground, athletic field or beach. This prohibition applies only to public playgrounds and beaches and is not intended to include private property to which the general public does not generally have access or private areas used exclusively for private functions. "No Smoking" signs, or the international "No Smoking" symbol, which consists of a pictorial representation of a burning cigarette enclosed in a circle with a bar across it, shall be prominently posted where smoking is regulated by this subsection. In the event a playground is not enclosed by fencing or other partition, no smoking shall be permitted beyond the signs posted in accordance with this section. This prohibition is not intended to include parking lots at beaches.
(O) 
Consume cannabis in a park or beach, including but not limited to parking lots.
(P) 
Use a skateboard, scooter or other similar device for any reason except in designated areas.
(Q) 
Violate the rules and regulations set forth in § 159-21(A) and (B).
(A) 
The Director shall develop such rules and regulations as he or she may deem proper or necessary to maintain the safety and welfare of park patrons and wildlife.
(B) 
Observation Deck at Crab Meadow Beach: The following regulations shall be observed at all times. Failure to comply with these rules and regulations shall be deemed a violation of this Chapter.
(1) 
The upper Observation Deck shall be open to the general public during regular beach hours (8:00 a.m. to 8:00 p.m.) only.
(2) 
The Observation Deck shall be open from Memorial Day through Labor Day.
(3) 
There will be no alcoholic beverages allowed on the Observation Deck.
(4) 
Children under the age of 12 are not permitted without adult supervision.
(5) 
Glass containers are not permitted.
(6) 
No animals permitted except in cases of ADA assistance (guide and service dogs).
(7) 
No musical and/or voice amplification devices.
(8) 
No skateboarding and/or rollerblading.
(9) 
No bare feet allowed.
(10) 
Smoking prohibited.
(11) 
No personal umbrellas and/or chairs allowed.
(12) 
Coolers prohibited.
(13) 
Private parties prohibited.
(14) 
Wait service from the restaurant specifically prohibited.
(15) 
No commercial use allowed.
(16) 
Drug free zone.
(A) 
No person or business entity, including a not-for-profit, religious, cultural or charitable organization, shall, within a park or within two hundred and fifty (250) feet of a park and any portion of a highway, roadway, sidewalk, walkway or path located thereat, engage in the following acts:
(1) 
Expose, display or show, or cause another to expose, display or show, for sale, lease or hire any article, product, service or thing; or
(2) 
Station, park, deposit or place, or cause another to station, park, deposit or place any stand, cart, wagon or vehicle for the transportation, sale, lease or hire of any article, product, service or thing; or
(3) 
Posts erect and/or maintain, or cause the posting, erection and/or maintenance of any sign, placard, advertisement or inscription for the sale, lease or hire of any article, product, service or thing.
(B) 
The prohibitions and restrictions contained in this section shall apply to signs, placards, advertisements and/or inscriptions which promote, advertise, publicize or endorse (i) sponsors of sporting, cultural or artistic events and activities; (ii) a person or business entity who sells, leases, provides, manufactures or distributes any product, item, service or thing; or (iii) religious, political or cultural beliefs.
(C) 
Exemptions. The provisions of this section shall not apply to the following:

(1) 
Activities conducted in the course of a carnival, circus, fair or amusement event for which a permit has been obtained in accordance with Chapter 91 of the Code of the Town of Huntington.
(2) 
Activities authorized pursuant to Chapter 149.
(3) 
Activities for which the Town Board or Town of Huntington Board of Trustees has granted a license or other approval.
(4) 
Signs, including off-premises advertising signs, mounted to and in connection with a bicycle share (or other similar shared micromobility service) station, dock or storage area, as well as on the bicycles (or other similar shared micromobility service vehicles) therein, pursuant to an agreement with and approved by the Town of Huntington or Town of Huntington Board of Trustees.
(5) 
Signs, including off-premises advertising signs, pursuant to a naming rights or sponsorship agreement with and approved by the Town of Huntington or Town of Huntington Board of Trustees, or in return for a donation made to the Town of Huntington, pursuant to an agreement with and approved by the Town of Huntington or Town of Huntington Board of Trustees.
(6) 
Youth sport leagues may post one (1) sign per league on the home field concession building, and if there is no concession then as determined by the Director of Parks and Recreation. No sign shall be posted without a permit having been issued by the Director of Public Safety, upon the recommendation of the Department of Parks and Recreation. It shall be unlawful to post more than one (1) sign, or to post a sign in more than one (1) park. Each league shall be entitled to a sign no larger than 3' x 4' in which to list the names of league sponsors only. In those parks where there are multiple leagues, the combined area for all leagues using the home field shall not exceed 4' x 8' (32 sq. ft.). The location, method of installation and appearance of such signs shall be as determined by the Director of Parks and Recreation. All signs shall be kept in good repair and shall be removed by the league within ten (10) days of the expiration of the field use permit. No freestanding signs shall be permitted, and no sign shall be posted along park fencing, or on wing fencing, outfield safety fences, dugouts or backstops, or at other locations within the park. Failure to obtain a permit, or keep the sign in good repair, or to remove a sign; and the posting of multiple signs, or promoting an article or service shall be deemed a violation of this article and good cause for the denial of an application for a permit the following season. All offending signs shall be removed and disposed of by the town.
(D) 
All signs, placards, advertisements or inscriptions which have been duly authorized prior to the effective date of this legislation shall be permitted to remain in place until January 1, 2003. Thereafter, the maintenance of such signs, placards, advertisements or inscriptions shall be in violation of this Article.
A. 
All town parks, beaches and special park facilities shall be closed to the public from sunset to sunrise except as specifically posted, and all activities will be restricted from these areas; provided, however, that group activities may be permitted if a permit has been obtained from the Director. In all cases, the Director of Parks and Recreation shall have the authority to adjust the opening and closing hours of all park and beach facilities as particular conditions may require.
B. 
Any park, beach, special park facility, or part thereof, may be declared closed to the public or closed to certain uses by the Director at any time for any interval of time, either temporarily or at regular and stated intervals (daily or otherwise), as in the discretion of the Director is reasonably necessary to maintain order or to protect the health, safety and welfare of park users or wildlife.
C. 
It shall be unlawful to park, loiter, use, occupy or congregate at any park or beach when closed to the public unless a permit has been issued by the Director, and no person shall use a park or beach at a time or hour other than as designated in the permit.
