It shall be unlawful for any person under the
age of 16 to possess any air gun or other instrument or weapon in
which the propelling force is a spring or air, or any gun or any instrument
or weapon in or upon which any loaded or blank cartridges may be used,
or any loaded or blank cartridges or ammunition therefor, or any dangerous
knife, provided that the holder of a hunting license or permit issued
pursuant to Article 11 of the New York State Environmental Conservation
Law and used in accordance with said law shall not be governed by
this section. A person who violates the provisions of this section
shall be adjudged a juvenile delinquent.
A parent, guardian other person legally charged
with the care or custody of a child less than 18 years old fails or
refuses to exercise reasonable diligence in order to control such
child to prevent him from becoming a juvenile delinquent or person
in need of supervision under terms defined in Articles 10, 3 and 7
of the Family Court Act of the State of New York (Penal Law § 260.10)
is guilty of a misdemeanor.
Except as otherwise provided by the Penal Law,
any person violating any provision of this chapter may be punishable
by a fine of not more than $250 or imprisonment for a period not exceeding
15 days, or both.
