V of Chapter
47 of the Farmington Code is repealed and the following is substituted in lieu thereof.
There is hereby established the office of Fire Marshal. The Fire Marshal
shall be appointed by and be responsible to the Town Manager and shall be
selected on the basis of ability to perform the duties of his office.
The Fire Marshal shall have the powers and the duties set forth in Part
II of Chapter 541 of the General Statutes of Connecticut to include, among
other powers and duties, the following:
A. The Fire Marshal shall be responsible for enforcement
within the Town of the State Fire Safety Code and the provisions of Chapter
541 of the General Statutes of Connecticut.
B. The Fire Marshal shall, in accordance with the provisions
of § 29-311 of the Connecticut General Statutes, investigate the
cause, origin and circumstances of any fire or explosion within the Town by
reason of which property has been destroyed or damaged, a person has been
injured or killed, incidents have occurred which threatened property with
destruction or damage or persons with injury or death, and shall especially
investigate whether such fire was the result of an incendiary device or the
result of carelessness, design or criminal act.
C. The Fire Marshal may inspect in the interest of public
safety all buildings and facilities of public service, all building and facilities used for manufacturing and all occupancies regulated
by the Fire Safety Code within the Town. In each case in which the Fire Marshal
conducts an inspection, he shall keep a record of such an investigation.
D. The Fire Marshal shall have the right of entry at all
reasonable hours into or upon any premises within the Town in the performance
of his duties, except with respect to the residential portion of buildings
designed to be occupied by three or more families which may only be entered
for inspection between the hours of 9:00 a.m. and 5:00 p.m. except in the
event of any emergency requiring immediate attention for safety to life or
in the interest of public safety.
