It shall be a civil offense pursuant to Chapter
126 of the Municipal Code of the City of Rehoboth Beach for any person under the age of 21 years to have upon or about his person or in his possession any alcoholic, malt or spirituous beverage within the corporate limits of the City; provided, however, that the provisions of this section shall not be applicable to any individual who was 20 years of age on January 1, 1984. Any person who violates this chapter shall pay a civil assessment of $100.

A. It shall be a civil offense pursuant to Chapter
126 of the Municipal Code of the City of Rehoboth Beach for any person under the age of 21 years to have alcoholic liquor in his possession at any time or consume or to be found to have consumed alcoholic liquor. Any person who violates this chapter shall pay a civil assessment of $100. This section shall not apply to the possession or consumption of alcoholic liquor in connection with any religious service or by members of the same family within the private home of any of said members.

B. This section shall not apply either to the consumption
of alcohol or spirituous beverage when consumed as an integral part
of the sacramental rights performed in the course of a religious service
conducted at a church building or other house of worship or where
such consumption is for medical purposes pursuant to the direction
or prescription of a physician or surgeon duly licensed to practice
within this state.
No person shall be drunk or under the influence
of alcoholic beverages and disorderly in any public place within the
city.

A. No person
shall drink any intoxicating liquor, including spirits, wine or beer,
or possess any open container containing intoxicating liquor, including
spirits, wine or beer, on any public street, the boardwalk, the beach,
the avenues or the sidewalks within the corporate limits of the City
of Rehoboth Beach.
B. Any violation of this section is declared a civil offense pursuant to Chapter
126 of the Municipal Code of the City of Rehoboth Beach.

A. Whenever in this chapter any act or failure to do
a required act is prohibited or is made or declared to be unlawful
or an offense or a misdemeanor, where no specific penalty is provided
therefor, the violation of any such provision of this chapter shall
be punished by a fine of not less than $50 nor more than $150, such
fine to be in the discretion of the court, and such violator shall
pay the costs of prosecution.
B. Whenever in this chapter there is no provision for
a greater penalty for a second or subsequent conviction for a violation
of this chapter, any person who has previously been convicted of the
same violation shall be subject to a fine of not less than $75 nor
more than $200 for each succeeding offense and shall pay the costs
of prosecution.
