No person shall burn or set fire to any lot or land; vegetation, growing or dead; trash; refuse; waste or other matter or thing unless done in an enclosed container, incinerator, stove or fireplace used in a dwelling or building, connected to a chimney or other device so constructed or equipped as to prevent the escaping of flames or sparks therefrom.

A. 
Whenever in this chapter any act or failure to do a required act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of this chapter shall be punished by a fine established in the City Schedule of Fees and Penalties,[1] such fine to be in the discretion of the court, and such violator shall pay the costs of prosecution.

B. 
Whenever in this chapter there is no provision for a greater penalty for a second or subsequent conviction for a violation of this chapter, any person who has previously been convicted of the same violation shall be subject to a fine established in the City Schedule of Fees and Penalties for each succeeding offense and shall pay the costs of prosecution.
