No person shall burn or set fire to any lot or land; vegetation, growing
or dead; trash; refuse; waste or other matter or thing unless done in an enclosed
container, incinerator, stove or fireplace used in a dwelling or building,
connected to a chimney or other device so constructed or equipped as to prevent
the escaping of flames or sparks therefrom.
The Rehoboth Volunteer Fire Department may burn off any lot within the
city at the request of the owner of the property.
Outside fireplaces shall be allowed for cooking purposes, but not for
burning of trash.

A. Whenever in this chapter any act or failure to do a required
act is prohibited or is made or declared to be unlawful or an offense or a
misdemeanor, where no specific penalty is provided therefor, the violation
of any such provision of this chapter shall be punished by a fine of not less
than $50 nor more than $150, such fine to be in the discretion of the court,
and such violator shall pay the costs of prosecution.
B. Whenever in this chapter there is no provision for a
greater penalty for a second or subsequent conviction for a violation of this
chapter, any person who has previously been convicted of the same violation
shall be subject to a fine of not less than $75 nor more than $200 for each
succeeding offense and shall pay the costs of prosecution.
