A. It shall be unlawful for any person to take, exercise
control over or obtain property of another person of a value of less
than $300 intending to deprive such person of it or appropriate it.
B. It shall be unlawful for any person in any capacity
to legally receive, take, exercise control over or obtain property
of another of a value less than $300 and fraudulently convert same
to his own use.

Any person violating any of the provisions of §
198-39 shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than $50 nor more than $150 or be imprisoned for a term of not less than 10 days nor more than 20 days, or both, and shall pay the costs of prosecution.
