A. 
It shall be unlawful for any person to take, exercise control over or obtain property of another person of a value of less than $300 intending to deprive such person of it or appropriate it.
B. 
It shall be unlawful for any person in any capacity to legally receive, take, exercise control over or obtain property of another of a value less than $300 and fraudulently convert same to his own use.

Any person violating any of the provisions of § 198-39 shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be subject to the penalties established in the City Schedule of Fees and Penalties,[1] and shall pay the costs of prosecution.
