It is the purpose of this article to establish parking areas for the use of persons to whom a special handicapped registration plate has been issued by the Department of Transportation of the State of Delaware or by another jurisdiction.
For the purposes of this article, the following definitions shall be applicable unless the context clearly indicates to the contrary:
VEHICLE OF THE HANDICAPPED
A vehicle which is displaying a special handicapped registration plate on the rear of the vehicle, issued by the Department of Transportation of the State of Delaware, or a vehicle displaying a special handicapped identification parking card issued by the Department of Transportation of the State of Delaware or a plate or permit issued under a similar provision by another jurisdiction.

It shall be unlawful for any person to park, stand or stop any vehicle, other than a vehicle of the handicapped, in any of the following areas:

A. 
Any person violating any of the provisions of this article shall, upon conviction, pay a fine not less than $100 nor more than $200 and shall pay the costs of prosecution, provided that, with the consent of the person charged with a violation under this section, the Chief of Police is authorized to accept and receive, without hearing, not less than $100 as a penalty for such violation if such penalty is paid within seven days from the date of violation or accept $150 if such violation is paid within 30 days from the date of the violation or accept $200 if such penalty is paid after 30 days from the date of the violation.

B. 
Any police officer or parking officer of the City, while in the performance of his duty, may remove or cause to be removed any motor vehicle parked in violation of this article at the expense of the owner or operator of such motor vehicle when the owner or operator is unable, unwilling or not available to move such vehicle immediately.
