No unauthorized person shall uncover, make any connections with or opening into, use, alter, or disturb any public sewer or appurtenance thereof without first obtaining a wastewater discharge permit. Any person proposing a new discharge into the system or a substantial change in the volume or character of pollutants that are being discharged into the system shall notify the Town at least 60 days prior to the proposed change or connection. Proposed new discharges from residential or commercial sources involving loading exceeding 50 population equivalent or any increase in industrial discharges must be approved by the New Hampshire Water Supply and Pollution Control Division. A discharge permit request must be filed by the Derry Wastewater Division on behalf of the applicant.
There shall be two classes of sewer permits, one for residential and commercial users and one for industrial users. In either case, the owner shall supply plans and specifications to the Director considered pertinent by the Director to the proposed sewer service. The permit application should be in the form as attached in Appendix D.[1] A permit and inspection fee pursuant to §§ 122-57 and 122-58 and Appendix A[2] shall be paid to the Tax Collector's office at the time of the application and submittal to the Director for approval. An accessibility fee shall be charged pursuant to § 122-54 and Appendix A on all new and expanding discharges as well.

A. 
All costs and expenses incidental to the installation and connection of the building sewer shall be borne by owner. The owner shall indemnify the Town from any loss or damage that may directly or indirectly be occasioned by the installation of the building sewer. Each and every building sewer constructed must have a six-inch cleanout assembly installed no more than five feet off the building foundation. The cleanout must be constructed so as to provide access to the building sewer from the cleanout to the public sewer main. Cleanouts must be constructed using suitable six-inch by six-inch wyes, six-inch-long sweeps and six-inch cap installed at the finished grade. Cast-iron covers must be placed at grade just above the six-inch access to the cleanout assembly.
B. 
Building sewers must be constructed so as to provide at least 10 feet of spacing between the sewer line and water services.
C. 
Only a utility service contractor licensed by the Town of Derry shall be permitted to make any service connections. A utility contractor may apply for a license to the Town as outlined in the "Sewer and Water Service Connection Specifications" dated April 1993.
A separate and independent building sewer shall be provided for every building, except that where one building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear building through an adjoining alley, court, yard, or driveway, the building sewer from the front building may be extended to the rear building and the whole considered as one building sewer.
Old building sewers may be used in connection with new buildings only when they are found, on examination and test by the Director, to meet all requirements of this chapter.
The size and slope of the building sewer shall be subject to the approval of the Director, but in no event shall the diameter be less than six inches. The slope of such six-inch pipe shall be not less than 1/8 inch per foot.
Whenever practical, the building sewer shall be brought to the building at an elevation below the basement floor. No building sewer shall be laid parallel to or within three feet of any bearing wall which might thereby be weakened. The depth shall be sufficient to afford protection from frost. The building sewer shall be laid at uniform grade and in straight alignment insofar as possible. Changes in direction shall be made only with properly curved pipe and fittings. In no case will more than one change of direction, up to 45º, be made without suitable cleanouts installed, as detailed in the approved "Sewer and Water Service Connection Specifications" dated April 1993 or the latest revision thereof.
In all buildings in which any building sewer is too low to permit gravity flow to the public sewer, sanitary sewage carried by such sewer shall be lifted by approved artificial means and discharged to the building sewer. Such means are to be constructed as detailed in the approved "Sewer and Water Service Connection Specifications" dated April 1993 or the latest revision thereof.
All excavations required for the installation of a building sewer shall be open trench work unless otherwise approved by the Director. Pipe laying and backfill shall be performed in accordance with ASTM specifications (c12-19), except that no backfill shall be placed until the work has been inspected.
All joints and connections shall be made gastight and watertight and of a type approved by the Director. All joints must be constructed so as to pass a standard air-pressure test of between 305 psig and held for five minutes with a maximum one psig loss of pressure.
A. 
The connection of the building sewer into the public sewer shall be made at the Y-branch if such branch is available at a suitable location. Where no Y-branch is available, under the direction of the Director, a neat hole may be cut by a tapping machine into the public sewer to receive the building sewer through a saddle fitting approved by the Director. Such connection shall be made completely watertight at the location specified by the Director and under the supervision and as directed by the Director.
B. 
Connection to manholes must be made so as to produce a watertight and flexible joint. A KOR-N-SEAL or equivalent as approved by the Director is acceptable.
The applicant for the building sewer permit shall notify the Director when the building sewer is ready for inspection and connection to the public sewer. The connection shall be made under the supervision of the Director or his representative.
All excavations for building sewer installation shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, parkways and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the Town. Open trenches shall not be left unattended.
The property owner is obligated to pay for repairs and maintenance of the building sewer from his building to the public sewer, including repair of the entire tee-wye and/or tee assembly installed in the public sewer main. The Town shall have the right to charge reasonable fees for a repair requiring excavation of the street to expose and repair a building sewer, such fee to be payable in advance of the excavation work. If it is determined by the Director that the Town is responsible for the blockage which occurred in the sewer main, then the fee will be refunded.
Building sewer must be installed as required in this Article IV and as detailed in the approved "Sewer and Water Connection Specifications" dated April 1993 or latest revision thereof and as further required in § 122-7 of this chapter.
The Town may request the right to install exterior building sewer cleanout assemblies in existing building sewers to be used for inspection and maintenance purposes. Costs for such work will be paid by the Town. If, after installation of the building sewer cleanout assemblies, future internal inspection reveals that repairs are necessary in the building sewer, then the building sewer repairs shall be paid in accordance with § 122-26.
A. 
No person(s) shall make connection of roof downspouts, foundation drains, areaway drains, or other sources of surface runoff or groundwater to a building sewer or building drain which in turn is connected directly or indirectly to a public sanitary sewer.
B. 
The connection of sump pumps to the sanitary sewer system is strictly prohibited.
