A. 
No person or corporation shall operate taxicabs or other vehicles for public conveyance regularly over the highways of the Town of Derry without first obtaining an annual license for the taxicab business from the Town Council.
B. 
No person shall operate a taxicab as a licensed driver without first obtaining an annual license from the Town of Derry.
C. 
No license to operate a taxicab or a taxicab business shall be issued to a person(s) who has been convicted of a felony, a misdemeanor which arose from fraud, theft, assault or whose motor vehicle record shows a conviction for one or more of the following; DWI, reckless operation, conduct after an accident or multiple speeding violations within the previous twelve-month period.
D. 
Each applicant, on an annual basis at the time of license renewal shall provide the Town of Derry a current motor vehicle record and current criminal history obtained through the State of New Hampshire Department of Safety. Said record shall be used to determine the applicants suitability to be licensed.
A. 
The license fee for such person or corporation to operate a taxicab business shall be $100. The said license shall expire December 31 of each year. Fees shall not be prorated.
B. 
The license fee for such person to operate a taxicab as a licensed driver shall be $25. The said license shall expire December 31 of each year. Fees shall not be prorated.
A. 
Before issuing said license for a taxicab business, the Town Council will require that the licensee procure public liability and property damage insurance for the protection of passengers and other members of the public.
B. 
The limits on such policies shall be not less than $100,000 for any one person and $300,000 for any one accident in respect to public liability and $100,000 for property damage. A certificate of such insurance must be furnished to the Town Council and kept current at all times.
Taxicabs used regularly by a licensee hereunder shall be registered so that the Town tax on any such vehicle shall be paid in the Town of Derry.
All such vehicles used as taxicabs as herein described shall be clearly marked with the name of the company in at least four-inch permanent lettering. Such lettering shall be visible from both sides of the vehicle. Vehicles used as taxicabs under this chapter shall only be operated by the person whose photo appears conspicuously displayed in said cab while transporting for hire.
All licensees hereunder shall be responsible to see that their vehicles shall not be operated at unreasonable speeds over the highways of the Town of Derry, and no such vehicle shall be operated with more passengers therein than the regular seating capacity of said vehicle.
As used in this chapter, the following terms shall have the meanings indicated:
TAXICAB
Any rubber-tired motor vehicle having a manufacturer's rated capacity of not more than seven passengers, used in the call and demand for transportation of passengers for compensation to or from points chosen or designated by the passengers and not operated on fixed schedules between fixed termini, or any such vehicle leased or rented, or held for leasing or renting, with or without a driver or operator.
A. 
Any person or corporation who violates any provision of this chapter shall be subject to a fine of $25 for the first offense and $100 for any subsequent offense in any twelve-month period.
B. 
Multiple and or egregious violations of any section(s) of this chapter may be cause for revocation of licenses issued hereunder.
