Pursuant to N.J.S.A. 40:48-2.46, the Chief of the Fire Department of the Borough of Eatontown is hereby authorized to enter upon parking yards and parking places, which are open to the public or to which the public is invited, whether maintained separately or in conjunction with any business or enterprise, and designate certain areas as Fire Department operation zones in accordance with the provisions of the Fire Prevention Code recommended by the American Insurance Association, 1970 Edition, as may be amended or supplemented or superseded by a new edition.
The Chief of the Fire Department, subject to the approval of the Mayor and Council, shall cause said Fire Department operation zones to be marked and posted so that parking shall be prohibited therein.
Prior to said marking and posting, the Chief shall, by letter, inform the property owner that he has so designated a fire operation zone and shall supply a plan of the designated area. The letter shall also state the date and place at which the matter will be submitted to the Mayor and Council for approval.
Any vehicle found parked in a marked and posted Fire Department operation zone may be impounded and towed by the Borough Police Department to an area near police headquarters, and the vehicle shall be returned to its owner upon payment of the reasonable costs of towing and storage.
Any member of the Borough Police Department may bring a complaint against the owner of any vehicle found parked in a marked and posted Fire Department operation zone in violation of this article and the matter shall be heard in the Municipal Court.
Upon a finding of violation of this article, the Municipal Judge may impose a fine or penalty in his discretion up to the maximum permitted by the laws of the State of New Jersey.
