A certain document; three copies of which are on file in the office of the Borough Clerk of the Borough of Eatontown, being marked and designated as the "BOCA National Existing Structures Code, Second Edition, 1987," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Existing Structures Code of the Borough of Eatontown, in the State of New Jersey, for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Existing Structures Code are hereby referred to, adopted and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes prescribed in §
145-2 of this chapter.
The BOCA National Existing Structures Code is amended and revised in
the following respects:
A. In Section ES-100.1 (page 1, second line), insert "Borough
of Eatontown."
B. Section ES-105.6 (page 5, first line) shall be changed
to read: "The code official shall recommend to the Mayor and Council, which
shall have power ......."
C. In Section ES-107.2 (page 6, fifth paragraph), where
there is a reference to the "appeals board or the appropriate review board,"
that shall be changed to mean the Municipal Court. All other references to
an "appeals board or appropriate review board" in the code, as amended, shall
mean the Municipal Court.
D. Section ES-110.2 shall be amended as follows:
(1) On page 8, third line, insert "not less than $25 nor
more than $1,000."
(2) On page 8, fourth line, insert "90 days."
(3) On page 8, fourth line, insert "at the discretion of
the Municipal Court."
E. In Section ES-111.4 (page 9, second line), insert "within
20 days."
F. Section ES-111.5 (page 9, second line). There shall be
substituted the "Borough Administrator" instead of the "code official."
G. Section ES-112. This entire section is deleted.
Chapter 77 of the Borough of Eatontown Code, entitled "Unfit Dwellings," adopted November 22, 1961, as amended, and Chapter
78, entitled "Unsafe Structures," adopted February 11, 1953, and all other ordinances and parts of ordinances in conflict herewith are hereby repealed.
Nothing in this chapter or in the existing structures code hereby adopted shall be construed to affect any suit or proceeding impending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in §
145-3 of this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
